On July 31, 2024, the Minister of Natural Resources and Environment of Vietnamissued Circular 08/2024/TT-BTNMT stipulating the land statistics, examination and the making of land use map in Vietnam

Guidance on provincial-level land statistics in Vietnam from August 1, 2024

According to Article 8 Circular 08/2024/TT-BTNMT, the following are the regulations on provincial-level land statistics in Vietnam:

- Preparation work:

+ Developing directive documents and plans for implementing land statistics in the provincial area;

+ Collecting relevant records, documents, and data related to land changes in the statistical year within the provincial area, provincial-level land planning records, and administrative boundary records at the provincial level; land inventory data from the previous cycle or land statistics data carried out in the previous year at the provincial level and other relevant documents;

+ Determining the scope of provincial-level land statistics in accordance with Article 3 of Circular 08/2024/TT-BTNMT;

+ Classifying, evaluating, and selecting the collected records, documents, and data.

- Review and synthesis of land changes during the statistical year:

+ For cases with changes in land type, users, and entities managing the land that have completed procedures for land allocation, lease, changes in land use purpose, and land withdrawal in the statistical year for domestic organizations; religious organizations, subordinate religious organizations; Vietnamese expatriates residing abroad, foreign-invested economic organizations; foreign organizations with diplomatic functions into the List of Cases with Changes during the Statistical Year and the Land Inventory Cycle in Appendix IV issued with Circular 08/2024/TT-BTNMT to send to the People's Committee of the commune, district level, except for commune-level units that have an integrated land database managed and operated systematically at all levels.

+ Providing guidance, inspection, pushing, and resolving difficulties and obstacles during the organization of land statistics implementation at district and commune levels.

- Receipt of district-level land statistics results and defense and security land statistics results from the Ministry of Defense and the Ministry of Public Security:

+ Reviewing and checking the district-level land statistics results for completeness and content compliance according to regulations; directing the district level to amend, complete the data, and report land statistics results (if any);

+ Reviewing and comparing the defense and security land data provided by the Ministry of Defense and the Ministry of Public Security with the local compiled data; in case of discrepancies, requesting the Ministry of Defense and the Ministry of Public Security to consider and unify.

- Processing, compiling provincial-level land statistics data:+ Preparing the tables as stipulated in points a, b, c, d, and dd of clause 1 Article 5 of Circular 08/2024/TT-BTNMT.

+ Analyzing and evaluating the current state of land use, causes of land changes in the land statistics year compared to the previous year's statistics and the preceding inventory cycle, proposing solutions to strengthen management and enhance land use efficiency in the provincial area.

+ Developing the provincial-level land statistics report with main contents:

+ Overview of natural, economic-social conditions; implementation situation, sources of data and documents used for compiling provincial-level land statistics and evaluating the reliability of the collected documents and data;

+ Assessment of current land use; evaluation of the implementation of land use planning and plans in the land statistics year; analysis of land changes in the land statistics year;

+ Assessment of changes in administrative boundaries, unresolved administrative boundary issues (if any);

+ Proposing measures to improve land management and use efficiency.

- Amend, complete the data, report provincial-level land statistics results if requested by the Ministry of Natural Resources and Environment according to clause 2 Article 9 of Circular 08/2024/TT-BTNMT.

- Finalizing, approving, and announcing provincial-level land statistics results according to clause 3 Article 59 of Land Law 2024.

- Duplicating and submitting provincial-level land statistics results according to clause 3 and point b clause 4 Article 22 of Circular 08/2024/TT-BTNMT.
