The housing repurposing according to the provisions of Decree 95/2024/ND-CP is carried out in the following cases in Vietnam.

Based on Decree 95/2024/ND-CP stipulating cases of housing repurposing in Vietnam from August 01, 2024, including:

(1) Conversion of function from resettlement housing to social housing

The functional conversion from resettlement housing to social housing can only be carried out when there is no longer a demand for resettlement housing in the area where the housing is located and the converted housing has a suitable area as per the standards for social housing as prescribed by the law on the development and management of social housing.

(2) Conversion of function from social housing to resettlement housing

The functional conversion from social housing to resettlement housing can only be carried out when there is no longer a demand for social housing in the area where the housing is located and there is a demand for resettlement housing.

(3) Conversion of function from official housing to resettlement housing

The functional conversion from official housing to resettlement housing can only be carried out when there is no longer a demand for official housing in the area where the housing is located and there is a demand for resettlement housing.

(4) Conversion of function from old public housing to official housing or social housing

- The functional conversion from old public housing to official housing can only be carried out when the converted housing has a suitable area as per the standards for official housing as mandated by the Prime Minister of the Government of Vietnam.

- The functional conversion from old public housing to social housing can be carried out when the converted housing has a suitable area as per the standards for social housing as prescribed by the law on the development and management of social housing.

- In the case where the State no longer requires the use of old public housing and such housing does not meet the standards for conversion, the property representative shall decide to auction the house in accordance with the law on property auction to recover funds for the budget.

(5) Cases where the Prime Minister of the Government of Vietnam decides on the housing repurposing or the conversion of housing function for auctioning

+ Functional conversion from public property social housing to official housing or from official housing to public property social housing;

+ Functional conversion from public property resettlement housing to official housing;

+ Functional conversion from student housing or worker housing to social housing to carry out renting, rent-purchasing, and sale of the housing as prescribed by the law on the development and management of social housing;

+ In the case where the above-mentioned student housing or the resettlement housing specified in item (1) does not meet the conditions for functional conversion to social housing, the project investor shall submit to the Prime Minister of the Government of Vietnam for consideration and approval on the authorization to auction such housing.

Principles of housing repurposing in Vietnam

According to Article 124 of the Housing Law 2023, the housing repurposing in Vietnam must comply with the following principles:

- Must be consistent with the approved provincial housing development program and plan, and must not cause any loss of public assets;

- The housing after functional conversion must be used efficiently, for the right purpose, and in accordance with the standards and technical regulations of the converted housing;

- Must be approved by the Ministry of Construction or the provincial People's Committee.
