Draft Decree stipulating the retirement age and conditions for receiving a pension is currently in the public consultation phase and is expected to take effect from January 1, 2021. One notable content in this Draft is the provision for late retirement for Vietnamese officials.

To be specific, according to this Draft, officials and those appointed to positions, titles specified in Appendix No. 01 issued with the Draft can at the age later while continuing to hold leadership and management positions.
POSITIONS, TITLES FOR LATE RETIREMENT
The competent authority decides the time for late retirement for Vietnamese officials according to the above regulations but must ensure that the retirement age for these cases does not exceed 5 years compared to retirement under ordinary working conditions at the time of retirement, as shown in the table below:

Note: Deciding on late retirement for the subjects mentioned above must ensure the following principles and conditions:
- Ensure objectivity, fairness, transparency, and conformity.
- The agency has a need for usage.
- The individuals have the desire, are healthy enough, and are not under disciplinary consideration, investigation, prosecution, trial, or execution of party and government disciplinary measures.
During the implementation of the policy of late retirement, if officials wish to stop working, they will be resolved for pension according to legal regulations, regardless of the age conditions for pension benefits at the time of retirement.
