Vietnam: Shall the medical practice certificate be extended in case its holder have not attended enough training lessons?

Hello LAWNET, I heard that in cases where the certificate holder does not attend enough training sessions to update knowledge, his/her medical practice certificate will expire. So if I have attended 30 consecutive training periods in 2 years 2018-2019, now I take 18 more lessons, can I extend my medical practice certificate?

LAWNET would like to answer this question as follows:

Currently, there are no regulations on the duration of medical practice certificates and procedures for renewal of this certificate.

Thus, in comparison with current legal regulations, your case is one of the cases of revocation of medical practice certificates, which is specified in Article 29 of the Law on Medical Examination and Treatment 2009 of Vietnam:

Article 29. Revocation of medical practice certificates and suspension of professional practice

1. A medical practice certificate shall be revoked when:

e/ The practitioner fails to update medical knowledge for 2 consecutive years;

To be more specific, according to Article 5 of Circular No. 22/2013/TT-BYT of the Ministry of Health of Vietnam on continuous training in health sector:

1. The medical officers, who have been issued certificate of practice and are practicing in medical examination and treatment, have obligation to participate in continuous training courses of 48 periods of learning in 2 consecutive years minimally.

According to Article 4 of Circular No. 22/2013/TT-BYT: “Medical officers, who practice in medical examination and treatment, fail to implement fully the training obligation in 2 consecutive years as prescribed in this Circular, are withdrawn certificate of practicing in accordance with law on medical examination and treatment.”

Based on the above regulations and according to the information you provided, in 2 consecutive years, you only participated in 30 training periods, which is not satisfactory as prescribed. Even if you take an extra 18 lessons, these 18 lessons will not be counted in 2018-2019, but will be counted in 2020. Thus, based on Article 4 of Circular No. 22/2013/TT-BYT, your medical practice certificate will be revoked.

According to Point a Clause 2 Article 4 of Decree No. 109/2016/NĐ-CP of Vietnam’s Government, even after your license is revoked, you can still apply for a new one. Procedures and application for reissuance of practice certificates are specified in Clause 2 Article 8 of Decree No. 109/2016/NĐ-CP of Vietnam’s Government.
