Resolution 05/NQ-HDLSTQ on the Fee Framework for Legal Practice Apprenticeship and Bar Association Membership

The editorial board of THU KY LUAT would like to address Mr. Truong's query as follows:

Currently, according to the content of Resolution 05/NQ-HDLSTQ, which regulates the fee framework for legal practice apprenticeship, bar association membership fees, membership fees, and cases of fee exemption and reduction, the fees payable when undergoing legal practice apprenticeship and joining the Bar Association in 2020 include:

1. Legal Practice Apprenticeship Fee

To be specific, according to Article 2 of Resolution 05, when registering for legal practice apprenticeship, the apprentice is required to pay a fee to the Bar Association. The highest fee for legal practice apprenticeship per person does not exceed VND 5,000,000.

Based on this fee framework, the attorney conference of the Bar Association will decide on the specific fee of the Bar Association, considering the support and facilitation for apprentices.

2. Bar Association Membership Fee

According to this Resolution, individuals joining the Bar Association must pay a membership fee to the Bar Association. The highest membership fee per person does not exceed VND 10,000,000. Based on this fee framework, the attorney conference of the Bar Association will decide specific membership fees, and cases of exemption and reduction to suit the specific and actual conditions of the Bar Association.

3. Membership Fee

According to Article 4 of Resolution 05, attorneys must pay membership fees as per the regulations of the Charter of the Vietnam Bar Federation. The membership fee is VND 200,000 per person per month.

In this context, attorneys who are 75 years old and above are exempted from membership fees. Attorneys who, due to health reasons, illness, cannot engage in professional activities, and submit an application for fee exemption or reduction may be considered for exemption or reduction.

Additionally, for attorneys not paying the membership fees, the consequences are as follows:

- Attorneys who do not pay the membership fee for 6 months will receive a written reminder from the Bar Association.- Attorneys who do not pay the membership fee for 12 months will be publicly notified within the Bar Association and the Vietnam Bar Federation.- Attorneys who do not pay the membership fee for 12 months will automatically be removed from the list of attorneys of the Bar Association.
