On November 4, 2022, the Minister of Industry and Trade of Vietnam issued Circular 30/2022/TT-BCT amending Circular 57/2018/TT-BCT guiding Decrees related to tobacco business.

1. Time to apply the templates of applications for License to manufacture tobacco products in Vietnam

Regulations on templates of applications and lists included in applications for License to manufacture tobacco products, and template of License to manufacture tobacco products shall come into force from

Thus, the time to apply the templates of applications for License to manufacture tobacco products is from January 1, 2028.

2. Regulations on inspection of tobacco business activities in Vietnam

* Periodic inspection in Vietnam

- Based on the actual status and requirements regarding the inspection of compliance with the Law on tobacco trading, regulatory authorities shall develop plans for annual inspection.

- A plan for annual inspection must include: Inspection purposes and requirements; inspected entities and inspection scope; contents to be inspected; inspection date and location; funding for covering inspection expenses; inspection teams; organizations assigned to conduct inspection; reporting on inspection results.

- Before each inspection, the inspection agency is required to notify the inspected organization or individual of the inspection plan at least 15 (fifteen) days before the inspection date.

* Unscheduled inspection in Vietnam

The inspecting agency shall carry out an inspection on an ad hoc basis in the following circumstances:

- A tobacco trader is found to commit violations against regulations laid down in Decree 67/2013/ND-CP dated June 27, 2013, as amended by Decree 106/2017/ND-CP.

- Unscheduled inspections shall be carried out upon the receipt of information from licensed mass media agencies, complaints or denunciations, or reports from organizations/ individuals.

- Unscheduled inspection is carried out at the request of a competent authority.

- The inspecting agency must not notify the inspection plan to the inspected organization or individual.

* Contents of inspection

- Inspect the compliance of applications for Certificate of eligibility to invest in tobacco cultivation, License to trade tobacco ingredients, License to process tobacco ingredients, License to manufacture tobacco products, and License to trade tobacco products, with regulations laid down in the Decree 67/2013/ND-CP and decrees on amendments thereof.

- Inspect the satisfaction of conditions for investment in tobacco cultivation, trading of tobacco ingredients, processing of tobacco ingredients, manufacturing of tobacco products, and trading of tobacco products as set forth in the Decree 67/2013/ND-CP and decrees on amendments thereof.

- Inspect the compliance with regulations on investment in innovation of equipment and technologies; investment in manufacturing/ processing of tobacco products for export; investment in processing of tobacco ingredients and investment in manufacturing of tobacco products abroad as laid down in the Decree 67/2013/ND-CP and decrees on amendments thereof.

- Inspect the compliance with regulations on utilization of specialty machinery and equipment in manufacturing of tobacco products, tobacco ingredients, cigarette rolling paper and stamps for tobacco products as laid down in the Decree 67/2013/ND-CP and decrees on amendments thereof.
