During traffic patrol and control, the Traffic Police force will have the following tasks and powers according to the Law on Road Traffic Order and Safety 2024.

Law on Road Traffic Order and Safety 2024 was passed by the 15th National Assembly of the Socialist Republic of Vietnam, 7th session on June 27, 2024.

Therein, it includes provisions on the tasks and powers of traffic police in traffic patrol and control in Vietnam.

Tasks of traffic police in traffic patrol and control in Vietnam

The tasks of traffic police in traffic patrol and control in Vietnam include:

- Observing and understanding the situation of people and vehicles participating in road traffic; the situation of road traffic order and safety; security and order on the road traffic route;

- Implementing the provisions at points b and c, clause 1, Article 65 Law on Road Traffic Order and Safety 2024, including:

+ Inspecting and controlling people and vehicles participating in road traffic;

+ Detecting, preventing, and handling violations of the law on road traffic order and safety and other legal violations.

- Guiding, propagating, and mobilizing people participating in road traffic to comply with the law on road traffic order and safety;

- Assisting and supporting people and vehicles participating in road traffic when necessary;

- Commanding and directing road traffic;

- Investigating and handling road traffic accidents according to the provisions of the law;

- Fighting against crimes operating on road traffic routes, ensuring security and order according to the provisions of the law; participating in anti-terrorism, demonstrations, disorder, epidemics, natural disasters, fires; participating in rescue and relief efforts;

- Detecting inadequacies in the road system, road traffic organization, causes leading to disorder and road traffic safety, notifying competent authorities or reporting to higher authorities to recommend competent agencies to take remedial measures;

- Coordinating with road management agencies to detect and prevent violations of legal provisions on road works protection and road safety corridors;

- Other duties according to the Law on the People's Public Security and other relevant laws.

Powers of traffic police in traffic patrol and control in Vietnam

According to clause 5, Article 65 Law on Road Traffic Order and Safety 2024, the powers of traffic police when performing patrol and control include:

- Stopping road traffic vehicles according to the provisions of Article 66, Law on Road Traffic Order and Safety 2024 to check compliance with road traffic rules; conditions of vehicles participating in road traffic; conditions of drivers participating in road traffic; regulations on ensuring road traffic order and safety according to the provisions of the Law on Road Traffic Order and Safety 2024 and other relevant laws;

- Handling administrative violations on road traffic order and safety and other legal violations;

- Mobilizing people, vehicles, and equipment in urgent cases; moving violating vehicles parked on the road causing obstruction, traffic jam, or posing a risk of road traffic accidents according to the provisions of Article 68 and Article 69 Law on Road Traffic Order and Safety 2024;

- Operating and using systems, vehicles, equipment, data according to the provisions of clauses 1, 2, 3, and 4, Article 67 Law on Road Traffic Order and Safety 2024 and weapons, supporting tools according to the provisions of Article 70 Law on Road Traffic Order and Safety 2024;

- Other authority according to the Law on the People's Public Security and other relevant laws in Vietnam.
