The contents of the overall contractor selection plan for the project in Vietnam in accordance with Article 15 of Decree 24/2024/ND-CP is as follows:
* Project implementation context analysis:
Identifying specific requirements, project objectives, analyzing factors in the project implementation context that may affect the tendering activities; the readiness to bid of contractors; factors including: legal regulations, economic, social, technological, sustainable tendering factors and other factors.
* Evaluation of capacity, resources, and execution experience of the investor:
Evaluating the capacity, resources, and experience to carry out the tendering activities includes:
- Capacity to carry out the process of selecting contractors from the step of developing the overall contractor selection plan (if any) to contract management;
- Results of the investor's tendering work through indicators: average savings rate; the average number of contractors participating in open bidding, limited bidding, competitive offers, online pricing according to the normal process, the proportion of packages with only one bidder in open bidding, limited bidding, competitive offers, online pricing according to the normal process; the proportion of packages with a protest on the bidding documents; the proportion of packages with a protest on other contents during the contractor selection process, contractor selection results; the number of times the clarifications on the bidding documents were not responded to, the protests on the bidding documents were not responded to, other contents during the contractor selection process and contractor selection results; other indicators (if any);
- Experience in implementing similar projects, handling protests in contractor selection, complaints, denunciations;
- Other factors.
* Market analysis and consultation:
- Market analysis and consultation include assessing risks and opportunities in the market related to the form of contractor selection being considered; the viability of contractor participation; the market for goods and services available for the project; market trends during the project implementation period.
Depending on the scale and nature of the package, market analysis and consultation include information on the availability of goods and services in the market; possible costs in case innovative and creative solutions are needed; warranty terms, types of contracts commonly applied to similar procurement packages of other investors; legal regulations (if any) relating to the package’s goods and services; possibility of sustainable tendering, procurement of environmentally friendly services, information on goods, services using recycled materials, energy-saving materials; the potential of small and micro-enterprises, startup innovation enterprises, enterprises using many female workers, wounded soldiers, disabled people, ethnic minorities to bid; supply chain analysis (the capability to supply materials, resources, goods, and services for contract execution); the potential for organizing the contractor selection process that only allows goods of Vietnamese origin to be bid in accordance with point e, clause 3, Article 10 and clause 1, Article 56 of the Law on Bidding 2023 and other necessary information;
+ Market consultation can be conducted using one or more of the following methods: referring to the most recent market consultation results for similar goods and services; posting market consultation questions on appropriate information channels; researching catalogs and product introduction materials of manufacturers, suppliers, distributors, agencies; referring to the experience of other investors who have conducted market consultations, consulting the results of organizing contractor selection for similar procurement packages; organizing market consultation conferences with potential contractors based on openness, transparency; gathering information from manufacturing, business units; consulting experts in relevant fields, printed press, magazines, industry-specific market analysis publications, information on the Internet, and other appropriate forms;
+ The investor can hire consultants to research and analyze the market, use the consultation opinions of independent specialists or functional agencies or enterprises in the market in developing the overall contractor selection plan, contractor selection plan, bidding documents, request documents but must ensure the principle of competition, fairness, and transparency;
+ In the absence of an overall contractor selection plan, the investor can conduct market analysis and consultation to develop a contractor selection plan, bidding documents, request documents.
- Identifying and managing risks in tendering:
+ Analyzing key risks related to the operating environment, market conditions, the capacity of the contractor selection organization, and the complexity of tendering activities;
+ Assessing the likelihood and impact of each risk on the project's tendering work;
+ Developing a risk management and mitigation plan for the project's tendering work through the application of appropriate contractor selection forms, methods, technical requirements, evaluation standards, and contract conditions.
- Specific objectives of tendering activities:
Identifying specific objectives of tendering activities (including specific objectives for sustainable tendering, if applicable) to ensure the overall objectives of the project.
- Plan for execution schedule of main tasks, packages:
Developing an overall schedule to execute main tasks, packages suitable to the project investment implementation schedule.
- Management of contractor selection work:
+ Dividing packages: dividing packages based on the scale and nature of the project tasks, in accordance with the project implementation schedule and based on market analysis and consultation results; determining the number of packages and the scope of work of each package, and identifying packages divided into parts;
+ Form and method of contractor selection: determining the appropriate form and method of contractor selection for each package in the project, clearly stating whether the package applies centralized procurement, shortlist selection, domestic or international;
+ Type of contract: determining the appropriate type of contract for each package;
+ Important content to note in the process of developing bidding documents, request documents, contract management (if any).
