The Agency Where Corruption Occurs, The Head Must Be Held Accountable

This is one of the notable new contents of the Anti-Corruption Law 2018, which officially took effect from July 01, 2019.

To be specific, according to the provisions at Article 72 of the Anti-Corruption Law 2018, the responsibility of the head and the deputy head of agencies, organizations, and units when corruption occurs in the agencies, organizations, and units under their management and charge is as follows:

- The head of the agency, organization, or unit shall bear direct responsibility when corruption occurs by individuals they directly manage or assign tasks to.

- The deputy head of the agency, organization, or unit shall bear direct responsibility when corruption occurs in the field of work and the units under their direct supervision; the head of the agency, organization, or unit shall bear joint responsibility.

Additionally, Anti-Corruption Law 2018 also clearly stipulates in Clause 1, Article 73 that the head and the deputy head of the agency, organization, or unit who bear direct responsibility for allowing corruption to occur shall be disciplined or criminally prosecuted depending on the severity of the corruption incident.

Previously, Anti-Corruption Law 2005 only stipulated that the head of the agency, organization, or unit is responsible for applying the provisions of this Law and other relevant legal regulations to organize the prevention and control of corruption in the agency, organization, or unit under their management, and at the same time is responsible to the directly superior agency, organization, or unit for the prevention and control of corruption in the agency, organization, or unit under their management, without specific provisions on the responsibility of the heads of units when corruption occurs.

Thus, it can be seen that the issuance of the Anti-Corruption Law 2018 as well as the clear stipulation of the responsibility of the heads has demonstrated the determination of the Communist Party and our State to push back against corruption, thereby contributing to purifying the leadership team at the current agencies and units.
