1. Conditions for the establishment of a party of all economic groups and corporations

1.1 For the party committees under the Party Committee of the Central Enterprise Division

The Party of all economic groups and corporations under the Party Committee of the Central Enterprise Division shall be established when the following conditions are fully satisfied:

- Being an economic group or a corporation established by the Prime Minister's decision or approved for establishment; (Previously, it was regulated that economic groups and special-class corporations were established by the Prime Minister's decision or approved for establishment.)

Having an important position in socio-economic, security and national defense.

- The activities of the enterprises are closely linked with each other, the accounting member units are dependent or attached, dependent on the parent company of the economic group, the corporation in terms of technology, engineering, finance, key markets, products and services.

- Juvenile units of economic groups and corporations are located in many areas but have little influence on political tasks and socio-economic development of the locality.

1.2 For party committees under local party committees

The Party of the whole corporation under the local Party Committee shall be established when the following conditions are fully satisfied:

- Is a corporation established by the People's Committee of the province or city directly under the Central Government or established by the decision of officials and branches.

- The activities of the enterprises are closely linked with each other, the accounting member units are dependent or attached, dependent on the parent company of the economic group, the corporation in terms of technology, engineering, finance, key markets, products and services.

- The corporation's member units are located in many provinces and cities but do not have great influence on the local political tasks and socio-economic development (previously, it was required to have a majority of party organizations. affiliated and located in the same province or city) .

2. Authority to decide on the establishment of a party committee

- The Party of all groups and corporations under the Party Committee of the Central Business Sector shall be established by the decision of the Party Committee of the Central Business Sector after obtaining the written consent of the Central Organization Committee.

- The Party of the whole corporation under the local Party Committee is established by the decision of the Standing Committee of the Party Committee directly above.

- The Party of the whole corporation is under the Party Committee of the block (belonging to the Party Committee of the province, the city party committee) to be established under the decision of the standing committee of the Party Committee of the block after obtaining the written consent of the organizing committee of the province or city party committee. .

3. Establishing a party committee of the parent company of economic groups and corporations

- Party committees of parent companies of economic groups and corporations include:

+ Party organization of units and enterprises that are members of the parent company according to decisions of competent authorities;

+ Organization of party branches, representative offices, member units in Hanoi, Ho Chi Minh City, Da Nang and some other provinces and cities or party organizations of units and businesses that are members of the company mother according to the decision of the competent authority.

- Party committees, cell branches and member units of economic groups and corporations, the rest are under the local Party Committee (provincial party committee, city party committee, district party committee, block party committee directly under the provincial party committee, city party committee). ).

4. Establishment of grassroots economic groups and corporations

Party committees of economic groups and corporations in which the immediate superior is a party committee directly under the Central Government (province party committee, city party committee or party committee directly under the central government) but have not yet met the conditions to establish a party committee at a higher level. At the grassroots level, the standing committee of the superior party committee directly decides to establish the grassroots party committee of economic groups and corporations.

5. Conditions for granting authority on the basis

The grassroots party committees under the Party committees of economic groups and corporations, of which the immediate superior level of the Party committees of economic groups and corporations is the Party committees directly under the Central Government, when fully meeting the following conditions: are assigned the right to exercise or pilot the exercise of a number of superior rights on the basis of:

- Having an important position in politics, economy, security and defense.

- Having a large scale, including many member units that are grassroots organizations within an enterprise unit operating on a wide scale (many provinces and cities).

- Having a number of 400 or more party members. (New content added)

- Being a party committee for 3 consecutive years, successfully completing tasks or more. (New content added)

The Party Committee of the Central Enterprise Division, the Party Committee of the province and the Party Committee of the city directly under the Central Government shall decide to delegate authority at the grassroots level to the grassroots Party Committee after obtaining the written consent of the Central Organization Committee.

6. The transfer and reception of party organizations

- Party committees in economic groups and corporations established by the Prime Minister's decision or approved for establishment; has an important position, operating nationwide, is now under the Party Committee, the branch is transferred to the Party Committee of the Central Business Sector.

- Party committees and branches in enterprises that are under the Party committees or branches not mentioned above and have their headquarters in any locality shall be transferred to the Party committees of that locality (except for party organizations in some enterprises). public utility industry directly serving the state management function of ministries and branches).

- Party organizations in subsidiaries, member units, branches and representative offices that are under the local Party Committee will be transferred to the Party's entire economic groups, corporations or directly under the Party committee. parent company of an economic group or corporation under the decision of a competent authority specified in Articles 3, 5 and 6 of Regulation 60-QD/TW . Regulation 60-QD/TW takes effect from March 8, 2022 and replaces Regulation 196-QD/TW dated November 24, 2008.
