Inserting advertisements into the content of articles and electronic articles may be fined up to VND 15 million in Vietnam.

This is one of the noteworthy things mentioned at Decree 38/2021/NĐ-CP regulations on sanctioning administrative violations in the field of culture and advertising in Vietnam.

Specifically, Clause 2, Article 38 of Decree 38/2021/ND-CP stipulates a fine of between VND 10,000,000 and VND 15,000,000 for one of the following violations of the regulations on advertising in the online press and websites in Vietnam:

- Do not design so that readers can actively turn off or open ads that are not in a fixed area;

- The waiting time for turning off or opening ads not in the fixed area exceeds 1.5 seconds;

- Designing and arranging the advertising section and the content of news and articles.

Thus, according to this regulation, from June 1, 2021, if the online newspapers and websites arrange and insert advertisements into the content of news and articles, they will be fined up to VND 15,000,000 in Vietnam.

In addition to being fined, online newspapers and websites that commit violations are also forced to remove ads from the content of news and articles posted in Vietnam.

In addition, Article 38 of this Decree provides for a fine of between VND 5,000,000 and VND 10,000,000 for electronic newspapers and websites in Vietnam

- Failing to notify according to regulations the names, addresses of organizations and individuals providing advertising services in Vietnam to the owners of websites of foreign organizations and individuals providing cross-border advertising services;

- Failing to report according to regulations on advertising service activities of organizations and individuals providing Vietnamese advertising services to the owners of websites of foreign organizations and individuals providing cross-border advertising services;

- Advertise on websites of foreign organizations and individuals providing cross-border advertising services but not through organizations and individuals providing advertising services registered for lawful activities in Vietnam.
