Decree No 69/2018/ND-CPRegulations on import of used electronic or cold appliances

Provisions on the right to trade in import and export

Pursuant to Article 3 of the Government's Decree No. 69/2018/ND-CP on freedom of import and export as follows:

- A Vietnamese trader that is not a foreign-invested business entity may export, import and carry out other related activities without any dependence on its registered business lines except for the goods under the lists of prohibited exports and imports as prescribed in this Decree; other prohibited exports and imports as prescribed by law; goods suspended from export or import.

A branch of a Vietnamese trader shall carry out foreign trade activities as authorized by the trader.

- Foreign-invested business entities, branches of foreign traders in Vietnam, when exporting or importing regulated by this Decree, shall fulfill Vietnam's commitments in treaties to which the Socialist Republic of Vietnam is a signatory, the list of commodities and the roadmap announced by the Ministry of Industry and Trade and comply with this Decree and relevant laws.

- Export and import activities of foreign business entities which do not have a presence in Vietnam and other related organizations and individuals in countries and territories which are members of the World Trade Organization and countries which have bilateral agreements with Vietnam shall be implemented in accordance with regulations of the Government.

Import and export procedures in Vietnam

Pursuant to Article 4 of the Decree No. 69/2018/ND-CP prescribing export and import procedures as follows:

- For goods imported or exported under permits, exporters or importers must have such permits granted by concerned ministries or ministerial-level agencies.

- For goods exported or imported under given conditions, exporters or importers must meet the conditions prescribed by law.

- For goods on the list of those subject to inspection prescribed in Article 65 of the Law on Foreign Trade Management, importers and exporters shall be subject to inspection by competent agencies as prescribed.

- For goods other than those mentioned above, traders shall only carry out import or export procedures at customs offices.

Import of used electronic in Vietnam and cold goods

Pursuant to Article 5 of the Decree No. 69/2018/ND-CP:

"Article 5. Prohibited exports and imports

1. Prohibited exports and imports must comply with current legal documents and the list of goods banned from export and import in Appendix I to this Decree.

2. Pursuant to Appendix I thereto, Ministries and ministerial-level agencies shall publish the list of prohibited exports and imports and their HS codes on the basis of discussion with the Ministry of Industry and Trade and mutual consent of the Ministry of Finance to their HS codes.

3. The Prime Minister shall consider allowing export of goods banned from export; allowing import of goods banned from import for special purposes, warranty, analysis, testing, scientific research, medicine, pharmaceutical production, national defense and security."

Pursuant to Section II Appendix I issued together with Decree No. 69/2018/ND-CP, used electronic in Vietnam or cold goods in the list of goods banned from import into Vietnam.

Therefore, the import of electronics and refrigerated goods into Vietnam cannot be conducted for business purposes.
