Elaboration and assignment of plans for implementation of national target programs in the 5-year period

According to Article 5 of Decree No. 27/2022/ND-CP, the formulation and assignment of the national target program on a five-year period are prescribed as follows:

- Formulation, assessment of and decision on the policy for investment and the decision on investment in national target programs shall be consistent with regulations laid down in Chapter II of the Law on Public Investment.

- Formulation of the national target program for a five-year period shall be carried out after the Prime Minister approves the decision on investment in the national target program; stipulate principles, criteria and norms for allocation of central government budget capital and the rate of reciprocal capital of the local government budget used for implementing the national target program.

- The program owners shall assume the prime responsibility for, and coordinate with component project owners and concerned agencies in, elaborating national five-year plans on national target programs and send them to the Ministry of Planning and Investment and the Ministry of Finance. Content of proposal includes:

+ Make a plan to assign objectives, tasks, and key contents of the national target program to the governing bodies of the program.

+ The plan on allocation of central budget capital, including total capital amounts, structure of central budget capital for each year of support for program-managing agencies.

+ Propose major solutions for implementing 5-year national target program plans.

- The Ministry of Planning and Investment shall assume the prime responsibility for summing up plans on national target programs in the five-year period and reporting them to competent authorities.

- The central budget for program-managing agencies.

Accordingly, the 5-year national target program shall be carried out in accordance with the Law on Public Investment.

Formulation and assignment of 5-year plans for implementation of national target programs by program-managing agencies

Under Article 6 of Decree No. 27/2022/ND-CP, the formulation and assignment of plans for implementation of national target programs in five-year period in localities and central agencies shall be carried out as follows:

- The elaboration of plans on the implementation of national target programs of five-year periods by the program-managing agencies shall be carried out after the Prime Minister assigns the five-year plans on national target programs.

- Grounds for planning:

+ The 5-year plans for socio-economic development and the medium-term plans for public investment of the Ministries, regulatory bodies and local governments.

+ Decision of the Prime Minister approving the investment in the national target program; Decision of the Prime Minister issuing principles, criteria and norms for allocation of central budget capital and the rate of reciprocal capital of local budget implementing the national target program.

+ The Prime Minister's decision to assign the five-year national target program.

+ To guide the development of objectives, tasks, contents and activities of implementing national target programs by program owners and component project owners.

- Contents of the local plan:

+ Objectives and targets for the 5-year period; specific tasks of each component project of each national target program.

+ Capability of mobilizing capital for implementation of national target programs, including: State budget capital (central budget, local budget); capital integrated from local programs and projects; credit capital; other lawfully raised capital (if any).

+ Principles, criteria and norms for allocation of state budget funds for implementation of national target programs in localities.

+ The contents and activities of, the projected capital amount and capital structure for each activity; the number of construction investment projects to be implemented under the particular mechanism; the list of priority investment projects (if any).

+ Solutions for capital mobilization and implementation.

- Contents of plans of ministries and central agencies:

+ Contents, tasks, activities, expected capital allocation, capital structure and list of investment projects (if any).

+ Solutions for organization of implementation.

- Within 30 working days from the date on which the Prime Minister appoints the national 5-year program, the governing bodies of the program shall formulate, approve and assign the 5-year program to implement the national target programs according to the Law on Public Investment and the Law on State budget.

Accordingly, the five-year national target programs of the ministries, central agencies and provincial-level People's Committees shall be elaborated after the Prime Minister assigns the five-year national target programs.
