Abolition of Several Conditions for Practicing Law in Vietnam

Recently, the Ministry of Justice issued Decision No. 1319/QD-BTP on the approval of the plan to reduce and simplify business conditions within the scope of management of the Ministry of Justice. Notably, there are changes regarding the conditions for practicing law in Vietnam in the near future.

To be specific, the Ministry of Justice advocates for simplifying conditions for practicing lawyers by amending Article 10, Article 17, and Article 18 of the Law on Lawyers 2006, with a focus on abolishing two conditions for obtaining a law practice certificate, including:

- Loyalty to the Fatherland;- Having health conditions ensuring the practice of law.

These conditions will be implemented under the common obligations of citizens as stipulated in the Constitution, while individuals practicing law must ensure their own health when practicing.

Thus, individuals wishing to practice law in Vietnam only need to meet the conditions of having a law practice certificate and joining the Bar Association. The conditions for obtaining a law practice certificate will include:

- Being a Vietnamese citizen;- Adhering to the Constitution and the law;- Having good moral character;- Holding a bachelor's degree in law;- Having undergone professional legal training;- Having completed the law practice internship period.

Additionally, in the case of lawyers establishing a law practice organization, the condition of "Having at least two years of continuous practice under a labor contract with a law practice organization or practicing individually under a labor contract with an agency or organization as stipulated by the Law on Lawyers" will also be abolished. This abolition aims to facilitate the establishment of law practice organizations by individuals.

Moreover, this Decision also advocates for abolishing several conditions regarding the practice of foreign lawyers in Vietnam, notary practice, bailiff practice, bankruptcy trustees, arbitrators, and others.
