New Policies to War Invalids and Martyrs in Vietnam in 2018

A series of preferential policies have been applied to wounded soldiers, martyrs, people with meritorious services to the revolution, as well as their relatives. This is considered the State's gratitude to those who have bravely fought, endured injuries, and sacrificed for the independence and freedom of the Fatherland.

1. Legal Assistance

Circular 08/2017/TT-BTP, effective from January 1, 2018, stipulates that individuals eligible for legal assistance include: people with meritorious services to the revolution, relatives of people with meritorious services to the revolution, war invalids, diseased soldiers, and close relatives of martyrs.

To be eligible for legal assistance, the aforementioned individuals must provide documentation as specified in Article 33 of Circular 08/2017/TT-BTP.

2. Exemption or Reduction of Service Fees for Receiving and Delivering Dossiers

Article 4 of Circular 22/2017/TT-BTTTT specifically stipulates the subjects eligible for exemption or reduction of fees for services of receiving and delivering dossiers and administrative procedure results through public postal services as follows:

- Individuals who participated in the revolution before the August 19, 1945 Uprising;- Vietnamese heroic mothers.

Additionally, the Circular also specifies cases eligible for a 50% reduction in service fees for receiving and delivering dossiers and results, such as:

- Heroes of the People's Armed Forces, Labour Heroes;

- War invalids and those entitled to war invalids' policies;

- Diseased soldiers;

- Individuals who participated in the resistance and were affected by toxic chemicals;

- Individuals who participated in the revolution or resistance and were imprisoned or exiled;

- Spouses, biological children, and parents of martyrs.

Circular 22/2017/TT-BTTTT is effective from January 1, 2018.

3. Policy on Giving Gifts to People with Meritorious Services to the Revolution in Vietnam

Decision 47/QD-CTN effective from January 15, 2018, guides the provision of gifts to individuals with meritorious services to the revolution on the occasion of Tet (Lunar New Year). Accordingly:

A gift worth VND 400,000 is given to individuals with meritorious services to the revolution who are receiving monthly preferential allowances, such as:

- Individuals who participated in the revolution before January 1, 1945;

- Individuals who participated in the revolution from January 1, 1945, to the August 1945 Uprising;

- Vietnamese heroic mothers;

- Heroes of the People's Armed Forces, Labour Heroes during the resistance period;

- War invalids, individuals entitled to war invalids' policies, type B war invalids, and diseased soldiers with a labor loss rate of 81% or higher;

- Individuals who participated in the resistance and were affected by toxic chemicals with a labor loss rate of 81% or higher;

- Individuals who contributed to helping the revolution who are receiving monthly nurturing allowances;

- Relatives of martyrs receiving monthly nurturing allowances;

- Relatives of two or more martyrs receiving monthly death benefits.

A gift worth VND 200,000 is given to individuals with meritorious services to the revolution who are receiving monthly preferential allowances, such as:

- War invalids, individuals entitled to war invalids' policies, type B war invalids, and diseased soldiers with a labor loss rate of 80% or lower;

- War invalids receiving labor loss policies;

- Individuals who participated in the resistance and were affected by toxic chemicals with a labor loss rate of 80% or lower;

- Individuals who participated in the revolution or resistance and were imprisoned or exiled;- Individuals who contributed to helping the revolution;

- Representatives of martyrs' relatives;

- Individuals worshiping martyrs (in cases where martyrs have no relatives).

4. Support and Benefits for Vietnamese Individuals with Meritorious Services to the Revolution Residing Abroad

According to Articles 4 and 5 of Decree 102/2018/ND-CP, effective from September 5, 2018, individuals who participated in the resistance against French and American forces and are residing abroad; individuals who participated in the war to protect the Fatherland, undertook international missions and are residing abroad, etc., are entitled to support policies calculated based on actual years of resistance, war to protect the Fatherland, undertaking international missions, and working as labor dispatchers (collectively referred to as working time). To be specific:

- For working time of up to 2 years, the support amount is VND 4,000,000;

- For over 2 years, from the 3rd year onwards, an additional VND 1,500,000 is added for each year.

If the entitled individual passed away before September 5, 2018, their relatives are entitled to a one-time support of VND 6,000,000.

In addition to the aforementioned support, these individuals are also entitled to other preferential policies, such as:

- Issuance of a certificate for participation in the resistance against French or American forces, participation in the war to protect the Fatherland, and undertaking international missions;

- If they return to settle in Vietnam, they are entitled to health insurance policies similar to those for individuals with meritorious services; upon death, the person arranging the funeral is entitled to a burial allowance.

5. Increase in Allowances and Preferential Supplements

According to Decree 99/2018/ND-CP, the standard amount for determining various allowances and preferential supplements for individuals with meritorious services to the revolution, as stipulated in this Decree, is VND 1,515,000.

The monthly allowance and preferential supplement levels are specified as follows:

Additionally, the Decree also stipulates annual preferential allowances and one-time preferential allowances. More details can be found in Decree 99/2018/ND-CP, effective from August 27, 2018.
