Procedures for appointment of judicial expert in labor, war invalids, and social affairs in Vietnam

On December 29, 2023, the Minister of Labor, Invalids, and Social Affairs of Vietnam promulgated Circular 18/2023/TT-BLDTBXH regulating judicial expert in labor, war invalids, and social affairs.

Procedures for appointment of judicial expert in labor, war invalids, and social affairs in Vietnam

The procedure for the appointment of judicial experts under the Ministry of Labor, War Invalids, and Social Affairs of Vietnam is prescribed as follows:

- Vietnamese citizens residing in Vietnam who meet the following standards may be considered for appointment as judicial experts. The head of a unit under the Ministry of Labor, War Invalids, and Social Affairs is responsible for selecting a qualified individual and sending the compiled documentation to the Legal Department:

+ Good health and moral character;

+ A university degree or higher, with at least 5 years of practical professional experience in the trained field.

In cases where the proposed individual for appointment as a forensic medical expert, psychiatric forensic expert, or criminal technical expert has directly assisted in forensic activities in an organization involved in forensic, psychiatric forensic, or criminal technical expertise, the period of practical professional activity must be at least 3 years;

+ For those proposed for appointment as judicial experts in forensic medicine, psychiatric forensics, and criminal technology, a certificate of training or professional expertise in appraisal is required.

Within 10 days from the date of receiving a complete and valid dossier, the Legal Department, in coordination with the Personnel Department, will review and submit the appointment proposal to the Minister of Labor, War Invalids, and Social Affairs.

- Within 10 days from the date of receiving the complete submission, the Minister of Labor, War Invalids, and Social Affairs will issue a decision on the appointment of judicial experts.

- Based on the decision of the Minister of Labor, War Invalids, and Social Affairs regarding the appointment of judicial experts, the Legal Department will compile and send the list of judicial experts to the Information Technology Center under the Ministry of Labor, War Invalids, and Social Affairs (hereinafter referred to as the Information Technology Center) to be posted on the electronic portal of the Ministry of Labor, War Invalids, and Social Affairs.
