The Standing Committee of the National Assembly agreed with the government's proposal on promulgating the government's Resolution to implement urgent measures to prevent and control the COVID-19 epidemic, according to the Resolution of the first session of the XV National Assembly (Resolution 30).

The contents of the Standing Committee of the National Assembly "approved" include: the decision to establish a facility to collect and treat people infected with COVID-19 and an operation license; The Ministry of Health was assigned to prescribe administrative procedures in the circular according to simplified procedures to meet the urgent requirements of epidemic prevention and control; Assign the Standing Committee of the People's Council to decide on issues within the competence of the People's Council and report them to the People's Council at the nearest meeting.

In addition, the payment of medical examination and treatment costs for Covid-19 patients at Covid-19 collection and treatment facilities (including expenses for treatment of other diseases during Covid-19 treatment) is due to The government will continue to direct the implementation in the direction that the state budget is responsible for paying all medical examination and treatment costs directly related to COVID-19 treatment. For COVID-19 patients with other diseases, the payment of medical examination and treatment expenses for these diseases must comply with the provisions of the Law on Prevention and Control of Infectious Diseases, the Law on Health Insurance, and other relevant laws.

In addition to deciding on contents according to its competence, the National Assembly Standing Committee also has a document to comment on the draft resolution, including the application of measures to prevent and control the epidemic.

Specifically, in urgent and timely solutions, the Standing Committee of the National Assembly allows the government and The Prime Minister of Vietnam to decide and take responsibility to take measures to limit the number of means (Point 3.1). The government requires people not to leave their places of residence for a certain period of time in some necessary areas and areas; organize forces to ensure security, social order, and safety in epidemic-affected areas; and take special measures on communication and use of means of communication and other measures that can be applied in a state of emergency to prevent the spread of disease in a timely manner.

The Government's draft Resolution also stipulates that, on the basis of assessing different risk levels of the epidemic under the guidance of the National Steering Committee for COVID-19 Prevention and Control, the Chairman of the Provincial People's Committee proactively decides to apply solutions in the spirit of Directive 15, Directive 16, and Directive 19 of The Prime Minister of Vietnam; depending on the situation, actual requirements may apply earlier, higher but not slower or lower than regulations.

In order to overcome the inconsistent and lack of drastic implementation in some localities over the past years, the National Assembly Standing Committee proposed the government further concretize the measures mentioned at Point 3.1 of Resolution No. 30 of the National Assembly. This serves as a basis for concerned localities, agencies, and organizations to actively apply flexibly while ensuring synchronization and consistency.

The Standing Committee of the National Assembly noted that government resolutions should not use ambiguous terms such as "earlier" or "higher" to avoid inconsistent interpretation, causing confusion for localities in the application. It can even create arbitrariness, inconsistency between localities or excessive application, obstructing production and business activities, affecting people's lives, reducing the effectiveness of epidemic prevention and control and the implementation of the "dual goals" of the whole country.

The Prime Minister of Vietnam recently directed provinces and cities to implement Directive 16 "whoever is there, wherever he is," not to let people leave their residence areas to return to their hometowns by personal means.

According to the Standing Committee of the National Assembly, for measures to restrict some vehicles, asking people not to leave their residences for a certain period of time in some necessary areas and areas, should clearly define and decentralize authority to decide in accordance with the scope and level of risk of the epidemic; clearly limit how long the maximum restriction period is. If this limit is exceeded, it must be reported to The Prime Minister of Vietnam for decision; criteria to determine which areas and locations are necessary areas and locations.

For special measures on communication and use of communication means, it is necessary to specifically list the measures to be applied (e.g. media seizure, communication, mandatory application installation, location tracking for tracking...).

The Standing Committee of the National Assembly also specified other measures that can be applied in the state of emergency to the current epidemic situation or cited specific articles and clauses of relevant laws and ordinances (Law on Infectious Disease Prevention and Control; Law on National Defense; State of Emergency Ordinance,...). As these are special measures, citizenship may be restricted in some cases.

In the implementation process, the Chairman of the People's Committee may decide to apply measures corresponding to a higher level of risk than the actual epidemic situation in the area at the time of making the decision, but must still ensure that they are within the general framework of regulations of the Government and Prime Minister. general. In the event that the locality considers that it is necessary to apply other measures that have not been prescribed, they must report it and get the opinion of the government or The Prime Minister of Vietnam before implementation.
