Regarding this issue, LawNet would like to answer as follows:

1. The mobile police must record it in the diary after resolving the incident in Vietnam 

Recording patrol and control log books; and handover books of weapons, explosives, support tools, vehicles, and professional technical equipment are specified in Article 17 of Circular 54/2022/TT-BCA as follows:

- When each violation is resolved, it must be immediately recorded in the patrol and control diary.

- Record a summary diary in chronological order, including:

+ Time (hour, minute, day);

+ Location (location, place name, area, target, route);

+ Content of inspection and control;

+ Handling measures: reminder, decision on warning, fine (ordinal number), record made (ordinal number), application of preventive measures, other measures.

- Record the handover of weapons, explosives, support tools, vehicles, and technical and professional equipment in order of time, location, quantity, and condition, and sign the handing party and the receiving party.

Thus, from January 1, 2023, the Mobile Police must record the incident in the diary after resolving the case.

2. Handling violations during patrol and control by Mobile Police in Vietnam

- When detecting a violation of the law on security and order, officers and soldiers on patrol and control must immediately prevent and stop the violation and notify the violator of the violation.

- In case the law violation is an administrative violation, officers and soldiers who are performing patrol and control activities shall issue decisions to sanction administrative violations within their sanctioning authority; in cases that do not fall under their sanctioning authority, make a record, apply necessary preventive measures, and immediately transfer it to the competent person for handling according to the provisions of the law on handling administrative violations.

- In case of detecting a criminal red-handed or a wanted person, the officers and soldiers performing patrol and control activities must prevent, arrest, neutralize violations, and immediately report them to competent persons for resolution according to the provisions of the law.

- In case a person is detected and it is decided to search, officers and soldiers who are performing patrol and control activities record information about that person (characteristics of the person, clothing, vehicle, and other characteristics) and at the same time report to the shift leader to contact and coordinate with the agency making the decision to search or the police of the commune, ward, or town to handle it according to regulations.

- In case vehicles, objects, documents, or assets are discovered and a search decision is made, officers and soldiers are conducting patrols, controlling, and protecting the scene, recording information about those vehicles, objects, documents, and assets, and at the same time reporting to the shift leader to contact and coordinate with the agency making the decision to trace or the police of the commune, ward, or town to handle the matter. according to regulations.

3. Weapons, explosives, support tools, vehicles, and professional technical equipment equipped for Mobile Police

- Weapons, support tools, and explosives equipped for Mobile Police.

- Vehicles include: Automobiles, motorbikes, special vehicles, boats, helicopters, and other vehicles equipped with priority signal lights and horns, have priority rights according to the provisions of the law. Both sides of cars, special vehicles, boats, and patrol helicopters have reflective Mobile Police badges printed on them; On both sides of the fuel tank or on the flanks of the rear tank of the patrol motorcycle, there are reflective Mobile Police badges.

- Professional technical equipment includes:

+ Video camera; cameras and audio recorders;

+ Flashlight lighting;

+ Walkie talkie;

+ Other professional technical and communication equipment according to regulations of the Ministry of Public Security.
