Which Documents Are Subject to Review and Systematization by the Ministry of Health?

Circular 19/2015/TT-BYT stipulates the inspection, handling, review, and systematization of legal normative documents in the field of state management by the Ministry of Health on July 15, 2015.

Circular 19/2015/TT-BYT stipulates that documents within the review and systematization scope of the Ministry of Health are those related to the state management field of the Ministry of Health, including:

- Laws and Resolutions of the National Assembly;- Ordinances, Resolutions of the Standing Committee of the National Assembly;- Orders and Decisions of the President;- Decrees of the Government of Vietnam;- Decisions of the Prime Minister of the Government of Vietnam;- Joint Circulars;- Circulars of Ministers, Heads of Ministry-equivalent agencies;- International treaties of which the Socialist Republic of Vietnam is a member;- Decisions, directives of Ministers, Heads of Ministry-equivalent agencies; Joint Circulars between Ministries, Ministry-equivalent agencies and central agencies of political-social organizations issued before January 1, 2009 that have not been annulled, abolished or replaced by other documents.

Additionally, the Circular also stipulates that documents within the review scope of the Ministry of Health are those related to the state management field of the Ministry of Health, including:

- Circulars of Ministers, Heads of Ministry-equivalent agencies;- Resolutions of the Provincial People's Council; Decisions and directives of the Provincial People's Committee;- Decisions and directives of Ministers, Heads of Ministry-equivalent agencies issued before January 1, 2009 that have not been annulled, abolished or replaced by other documents;- Documents containing legal norms issued by other agencies not in the correct format, authority detected by organizations, individuals requesting, proposing, and sending to the Ministry of Health. Specifically:

- Documents containing legal norms on health issued by Ministers, Heads of Ministry-equivalent agencies but not in the form of circulars, joint circulars;- Documents containing legal norms on health issued by the People's Councils, Provincial People's Committees but not in the form of resolutions of the People's Councils, decisions, directives of the People's Committees;- Documents containing legal norms on health or documents with form and content like legal documents issued by Heads of agencies under the Government of Vietnam, Heads of agencies and units under Ministries, Ministry-equivalent agencies, agencies under the Government of Vietnam, Chairmen of People's Committees at all levels, Heads of specialized agencies under the Provincial People's Committees.
