According to Decision 446/QD-TTg in 2010 on the establishment, position, and functions of the National Council for Nuclear Safety:
- The National Council for Nuclear Safety (hereinafter referred to as the Council) is established to assist the Prime Minister in directing and resolving important inter-sectoral issues regarding nuclear safety.
The Council is officially named the National Council for Nuclear Safety (NCNS).
- The Council uses the seal of the Ministry of Science and Technology. The operating budget of the Council is ensured by the state budget and arranged by the Ministry of Science and Technology from the scientific career funding source.
- The term of office of the Council is 5 years.
Therefore, the National Council for Nuclear Safety is an advisory body to assist the Prime Minister in directing and resolving important issues regarding nuclear safety, with a term of office of 5 years.
The National Council for Nuclear Safety has the following tasks and powers, according to Article 2 of Decision 446/QD-TTg in 2010:
- Propose to the Prime Minister policies and measures to ensure nuclear safety in the use of atomic energy, during the operation of nuclear power plants, and in dealing with particularly serious nuclear incidents.
- Evaluate the reports of the Radiation and Nuclear Safety Agency on the results of operational assessment and the safety analysis report of nuclear power plants, the results of safety inspections for construction, changes in scale and scope of operations, installation, and safety testing of nuclear reactors in nuclear power plants.
- Exchange and reach consensus with the Ministry of Industry and Trade before the Ministry of Industry and Trade grants licenses for trial operation and official operation of nuclear power plants.
- Organize practical surveys and discussions and solicit opinions and contributions from experts and scientists inside and outside the country on important issues related to nuclear safety.
- Carry out other tasks assigned by the Prime Minister regarding the development of nuclear energy applications and nuclear safety.
- Regularly or unexpectedly report to the Prime Minister on the activities of the Council and important issues related to nuclear safety.
The members of the National Council for Nuclear Safety include:
- The Chairman of the Council is the Minister of Science and Technology.
- The Standing Vice Chairman of the Council is the Deputy Minister of Science and Technology.
- The Vice Chairman of the Council is the Deputy Minister of Industry and Trade.
- Council members:
+ Deputy Minister of Health;
+ Deputy Minister of Natural Resources and Environment;
+ Deputy Minister of Public Security;
+ Deputy Minister of National Defense;
+ Director of the Radiation and Nuclear Safety Agency;
+ Some experts in nuclear safety.
- The Chairman of the Council presides over and coordinates with relevant ministries and sectors to consider and decide on the list of Vice Chairmen and Council members.
