According to the regulations in Article 20 of Decree 94/2010/ND-CP, the cases eligible for postponement or exemption from compulsory community-based rehabilitation in Vietnam include:
- Cases eligible for postponement of implementing compulsory community-based rehabilitation decisions:
- Suffering from a serious illness with certification from a hospital at the district level or higher.
- Pregnant women with certification from a hospital at the district level or higher or women currently raising children under thirty-six months old.
To ensure these individuals can continue with the detoxification process, the Chairman of the Commune-level People's Committee, based on the medical facility's decision on the treatment duration and the time required to raise young children, will decide the postponement period. Upon the expiry of the postponement period indicated in the decision by the Chairman of the Commune-level People's Committee where the individual resides, the individuals must continue to execute the decision. If they do not voluntarily comply, they will be compelled to execute the decision according to the provisions of the Ordinance on Handling Administrative Violations.
- Cases eligible for exemption from implementing the decision:
- Suffering from a terminal illness with certification from a medical facility at the district level or higher.
- During the postponement period, if the individual voluntarily detoxifies, abstains from using drugs, and obtains a Certification of Completion of Voluntarily Detoxification.
