Vietnam: What contents are required in the decision on announcement of administrative procedures?

According to Circular No. 02/2017/TT-VPCP of Vietnam’s Government Office, structure of the decision on the announcement of administrative procedures includes the followings:

- Decision.

- List of newly issued, amended, supplemented, replaced, or abolished administrative procedures.

- Specific content of each administrative procedure (in case of newly issued, amended, supplemented, or replaced administrative procedures) and accompanying documents (if any), including application forms, declaration forms; fees, charges; result forms/ requirements, and conditions.

Concurrently, Circular No. 02/2017/TT-VPCP also stipulates the structure and specific content of the decision on the announcement of the list of administrative procedures under the jurisdiction of authorities of provinces and centrally-affiliated cities as follows:

- The structure of the decision includes two parts: Decision and List of administrative procedures under the jurisdiction of authorities of provinces and centrally-affiliated cities.

- List of administrative procedures which are arranged according to the jurisdiction and fields of resolution.

- Content of the list of administrative procedures, including name, time, location of implementation, legal basis, and fees or charges in cases of decentralization or authorized regulation.

Notably, based on practical conditions, the Ministry, sector, and localities shall apply digital signatures to electronic versions of the decision on the announcement, in accordance with the regulations on digital signatures and digital signature authentication services.
