Vietnam: The decision on announcement of administrative procedures must be publicly disclosed

On October 31, 2017, the Vietnam’s Government Office issued Circular No. 02/2017/TT-VPCP, which prescribes the public disclosure of administrative procedures at the offices of the direct-receiving agencies and units.

According to Circular No. 02/2017/TT-VPCP of Vietnam’s Government Office, the public disclosure of administrative procedures at the offices of agencies and units directly receiving and handling administrative procedures must meet the following requirements:

- The public disclosure of administrative procedures must be organized in a timely manner, ensuring that the administrative procedures are publicly disclosed on the effective date of the announced decision and not disclosing administrative procedures that have expired.

- The public disclosure of administrative procedures must ensure the accuracy, clarity, and completeness of the administrative procedures and the components forming the administrative procedures according to the announced decision and data extracted from the national database for administrative procedures in the announced list of administrative procedures; it must maximize convenience for organizations and individuals to access, understand, and carry out administrative procedures; it must ensure the legitimate rights and interests of individuals and organizations. Concurrently, it must also provide a basis and conditions for monitoring the process of receiving and handling administrative procedures by state officials.

- In cases where the publicly disclosed administrative procedures include application forms or declaration forms, these forms must be attached immediately after the administrative procedures. The paper version of administrative procedures posted publicly must be guaranteed not to be damaged, torn, or tarnished. In the case of electronic disclosure, the application forms or declaration forms must be readily available for individuals and organizations upon request.
