The Ministry of Public Security is drafting a Circular stipulating the specialized inspection procedures of the People's Public Security Forces in Vietnam

This Circular stipulates the principles, authority, procedures, and steps for conducting specialized inspections by the People's Public Security force in Vietnam  and will replace Circular 128/2021/TT-BCA.

The draft Circular inherits provisions from Circular 128/2021/TT-BCA and introduces several new points as follows:

- Regarding the names of the articles in the draft Circular: The names of the articles have been amended to align with the new regulations of the Inspection Law 2022, Decree 43/2023, Decree 03/2024, and the Decree on the organization and operation of the Public Security inspection force, specifically such as: "Authority to issue inspection decisions", "Collecting information to prepare for inspection", "Issuing inspection decisions", "Conducting direct inspections", "Inspection Team Logbook".

- Regarding the structure and content of the draft Circular:

+ One article is omitted compared to Circular 128/2021/TT-BCA, specifically Article 5 on "forms of inspection" is omitted because it has been stipulated in Article 46 of the Inspection Law 2022. The inspection activities of the People's Public Security force only include two forms: planned inspection and ad-hoc inspection; there are no other forms of inspection.

+ One new article is added compared to Circular 128/2021/TT-BCA, specifically Article 7 on "Composition of the Inspection Team", which stipulates that the Inspection Team consists of the Inspection Team Leader, the Deputy Inspection Team Leader, inspectors, and members of the Inspection Team; at the same time, it specifies the tasks and authorities of each member of the Inspection Team.

+ Proposes to retain (inherit) 07 Articles of Circular 128/2021/TT-BCA in the draft Circular, specifically: Article 13 (developing and approving the inspection plan), Article 14 (developing the outline for subjects of inspection to report), Article 15 (disseminating the inspection plan), Article 16 (Notification of the issuance of the inspection decision), Article 22 (concluding direct inspection), Article 24 (reviewing the inspection report), Article 32 (responsibility for enforcement).

+ Amends, supplements, replaces part of the contents of 24 Articles in the draft Circular

(1)  Article  1  -  Scope  of  regulation,  (2)  Article  2  -  Subjects  of  application,  (3)  Article  3  -  Terminology  explanation,  (4)  Article  4  -  Principles  of  specialized  inspection  activities,  (5)  Article  5  -  Authority  to  issue  inspection  decisions,  (6)  Article  6  -  Monitoring  activities  of  the  Inspection  Team,  (7)  Article  8  -  Changing  members  of  the  Inspection  Team,  Inspection  Team  leader,  supplementing  members  of  the  Inspection  Team,  mobilizing  officers  to  join  the  Inspection  Team,  (8)  Article  9  -  Procedures  for  changing  the  Inspection  Team  Leader,  Deputy  Inspection  Team  Leader,  members  of  the  Inspection  Team,  supplementing  Deputy  Inspection  Team  Leader  (9)  Article  10  -  Inspection  Team  Logbook,  (10)  Article  11  -  Collecting  information  to  prepare  for  inspection,  (11)  Article  12  -  Issuing  inspection  decisions,  (12)  Article  17  -  Announcing  the  inspection  decision,  (13)  Article  18  -  Conducting  direct  inspections,  (14)  Article  19  -  Reporting  the  progress  and  results  of  the  inspection  tasks,  (15)  Article  20  -  Transferring  files  to  the  Investigative  Agency  or  other  competent  authorities,  (16)  Article  21  -  Extending  the  inspection  duration,  (17)  Article  23  -  Reporting  the  inspection  results,  (18)  Article  25  -  Drafting  the  inspection  conclusion,  (19)  Article  26  -  Appraising  and  handling  the  appraisal  results  of  the  draft  inspection  conclusions,  (20)  Article  27  -  Signing,  issuing  the  inspection  conclusion,  (21)  Article  28  -  Publicizing  the  inspection  conclusion,  (22)  Article  29  -  Summarizing  the  activities  of  the  Inspection  Team,  (23)  Article  30  -  Inspection  dossier,  (24)  Article  31  -  Effect  enforcement.
