Vietnam’s Circular 11: Subjects to be sanctioned for administrative violations in the field of industrial property

Recently, the Minister of Science and Technology of Vietnam officially issued Circular No. 11/2015/TT-BKHCN detailing and guiding a number of articles of Decree No. 99/2013/NĐ-CP of Vietnam’s Government on sanctioning of administrative violations in the field of industrial property.

According to Circular No. 11/2015/TT-BKHCN of the Ministry of Science and Technology of Vietnam, subjects to be sanctioned for administrative violations in the field of industrial property include:

- Individuals that commit administrative violations in the field of industrial property, including:

+ Vietnamese citizens or foreigners;

+ Business households established and operating in accordance with the law on business registration.

- Organizations that commit administrative violations in the field of industrial property, including:

+ Public non-business units, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, and socio-professional organizations;

+ Economic organizations established in accordance with the Law on Enterprises, including private enterprises, joint-stock companies, limited liability companies and partnerships;

+ Economic organizations established in accordance with the Law on Cooperatives, including cooperatives and unions of cooperatives;

+ Economic organizations established in accordance with the Law on Investment;

+ Other lawfully established organizations.
