Vietnam’s Circular 11: 04 contents required in the Regulation on resolving disputes

This is an important content specified in Circular No. 11/2014/TT-BTC of the Ministry of Finance of Vietnam guiding a number of articles specified in Decree No. 86/2013/NĐ-CP dated July 29, 2013 of Vietnam’s Government on the business of prize-winning electronic games for foreigners.

According to Circular No. 11/2014/TT-BTC of the Ministry of Finance of Vietnam, enterprises must elaborate Regulation on resolving disputes among players with each other, between players and enterprises in business facility. Regulation on resolving disputes must have the following basic contents:

- Cases in which disputes are settled under the regulation on resolving disputes;

- The process of and procedures for resolving disputes, in which specify: Dossier of requesting for settlement of disputes, division of receiving dossiers, duration for settling disputes by enterprises and competency to decide on settling disputes;

- Specific responsibilities of parties during the course of resolving disputes;

- Other relevant contents as prescribed by enterprises.

Moreover, enterprises must list and issue leaflets to publicize the Regulation on resolving disputes at their business facilities.

Also according to Circular No. 11/2014/TT-BTC, relevant parties shall implement in accordance with Regulation on resolving disputes in business facility. If one of the parties does not agree on the result of resolving disputes, parties may conduct procedures to sue at Court for settlement as prescribed by civil law of Vietnam.
