Vietnam: Revealing state secrets about national reserves in any form is strictly prohibited

The Law on the National Reserves of Vietnam was promulgated on November 20, 2012. This Law consists of 06 chapters and 66 articles, prescribing the formation, management, and use of the national reserves; the rights and responsibilities of organizations and individuals to the activities related to national reserves. There are certain prohibited acts specified in this Law.

Specifically, according to Article 22 of the Law on the National Reserves 2012 of Vietnam, prohibited acts in activities related to national reserves include:

First, revealing state secrets about national reserves.

Second, taking advantage of the storage, release, purchase, sale, preservation or transportation of commodities in the national reserve, altering prices of commodities in the national reserve without permission for profiteering.

Third, irresponsibly or deliberately acting against the regulations on the management of national reserves, thus causing damage, loss or waste of assets belonging to national reserves.

Fourth, violating or sabotaging infrastructure or commodities of national reserves.

Fifth, obstructing activities related to national reserves.

Sixth, using commodities of national commodity for improper purposes.

Seventh, storing, releasing, purchasing and selling commodities in national reserve ultra vires, or inconsistently with the proper types, quantities, quality, or locations.

Eighth, illegally intervening in activities related to national reserves.

Nineth, improperly implementing the laws on accounting and statistics in activities related to national reserves.

Tenth, hiring unqualified organizations to preserve commodities in national reserves.

The Law on the National Reserves 2012 of Vietnam officially takes effect from July 01, 2013.
