Vietnam: Composition of an application for the license to export agricultural plant varieties

On December 28, 2018, the Ministry of Agriculture and Rural Development of Vietnam issued Circular No. 43/2018/TT-BNNPTNT on export and import of plant varieties, animal breeds, plant gene resources; import of agrochemicals and import of objects on the list of objects that have to undergo pest risk analysis before import.

According to Circular No. 43/2018/TT-BNNPTNT of the Ministry of Agriculture and Rural Development of Vietnam, export of agricultural plant varieties must be licensed by competent authorities, the application of which consists of:

- Application form No. 01/TT in Appendix I hereof;

- Technical declaration form No. 02/TT in Appendix I hereof;

- A copy of the certificate of enterprise registration or certificate of business registration (if required) or investment registration certificate (if the applicant is a foreign-invested enterprise), or ID card (if the applicant is an individual);

- In case of export serving research or international cooperation, 01 copy of the cooperation agreement in the foreign language and 01 Vietnamese translation certified by a translation agency;

- In case of export for display at an exhibition, 01 copy of the confirmation or invitation to the exhibition in the foreign language and 01 Vietnamese translation certified by a translation agency;

- In case of export as gift, 01 copy of the confirmation by both parties in the foreign language and 01 Vietnamese translation certified by a translation agency.
