Vietnam: Circular 06 newly regulates the remuneration for members of the Management Board of apartment buildings

This provision is mentioned in Circular No. 06/2019/TT-BXD of the Ministry of Construction of Vietnam on the Regulation on amendments to some Articles of Circulars relating to management and use of apartment buildings.

Specifically, currently, the remuneration for members of the Management Board shall be contributed by owners, occupants through decisions given in the meeting. Moreover, according to new regulations of Clause 8 Article 1 of Circular No. 06/2019/TT-BXD of the Ministry of Construction of Vietnam, from January 01, 2020, the apartment building convention may refer to the region-based minimum wages stipulated by the State to consider deciding a payment corresponding to the responsibilities and obligations of members of the management board according to specific conditions of each block or complex and area, except for the case where the members refuse to receive the payment.

Region-based minimum wages newly regulated in Decree No. 90/2019/ND-CP of Vietnam’s Government will apply from January 01, 2020, specifically as follows:

- For enterprises located in region I: VND 4,420,000/month.

- For enterprises located in region II: VND 3,920,000/month.

- For enterprises located in region III: VND 3,430,000/month.

- For enterprises located in region IV: VND 3,070,000/month.

If the apartment building has an operating unit in accordance with the Law on Housing and the Regulation enclosed with Circular No. 02/2016/TT-BXD of the Ministry of Construction of Vietnam, the apartment building owners and occupants shall pay the management board's members via this operating unit; the payment shall not be included in the operating unit’s business activities. If the apartment building does not have an operating unit in accordance with the Law on Housing and this Regulation, the management board shall collect the payment and pay each member.

Besides, Circular No. 06/2019/TT-BXD also stipulates that members of the apartment building’s management board are encouraged to join training courses on management and use of apartment buildings organized by the training institutions recognized by the Ministry of Construction.
