Vietnam: Acts that are strictly prohibited when using apartment buildings

Ensuring the rights and interests of each household and individual in the use of apartment buildings is a matter of great concern for many people. So, how are Vietnam’s regulations on acts that are strictly prohibited when using apartment buildings?

According to Article 35 of Decree No. 99/2015/ND-CP of Vietnam’s Government, Article 2 of Appendix 02 enclosed with Circular No. 28/2016/TT-BXD and Article 2 of Appendix 01 enclosed with Circular No. 02/2016/TT-BXD of the Ministry of Construction of Vietnam, acts that are strictly prohibited when using apartment buildings include:

- Burn votive papers, make a fire in the apartment building except in locations as prescribed;

- Use the funding for management, operation, and maintenance of shared area against provisions;

- Cause permeation or leakage; make noise beyond the limits specified by law; discharge garbage, wastewater, exhaust gases, toxic substances against regulations of law on environmental protection or internal regulations on management and use of the apartment building;

- Cause loss of security and order, talk filth and use radio, TV or sound equipment which give high-decibel noise;

- Breed animals in the apartment building;

- Throw objects out of windows or balcony of the apartment building;

- Paint, decorate the outer sides of the apartments of apartment building against regulations on its design and architecture;

- Transform uses and purposes of shared portions and facilities of the apartment buildings on one’s own initiative;

- Hang out the washing or put clothing and objects on handrails or the space from handrails upward or across windows of the apartment;

- Organize activities of gambling and prostitution in the apartment building;

- Conduct illegal trade, storage and use of drugs in the apartment and other areas in the apartment building;

- The following business lines are prohibited in the business area of an apartment building:

+ Explosive, combustible materials, and business lines that endanger life and property of users of the apartment building as set out in regulations of law on fire safety;

+ Discotheque business; repair of motor vehicles; slaughtering, provision of services causing pollution as set out in regulations of law on environmental protection.

- Any other prohibited acts related to management and use of apartment buildings specified in Article 6 of the Law on Housing 2014 of Vietnam, such as:

+ Infringing the homeownership of the State, organizations, households or individuals;

+ Renovating, expanding, demolishing the houses under agreements on housing lease, lease purchase, lending, permission for stay, or authorization of housing management without the consent of the homeowner;

+ Using the apartments not for residential purposes.

- Other acts causing adverse influence on the community and occupants in apartment units shall be subject to the consideration and decision by the apartment building meeting.

The above are the prohibited actions when using residential apartments. In practice, these prohibited actions are specifically outlined in the apartment building's management regulations and rules, as determined by the apartment owners' association.
