Vietnam: 09 steps for preparing and selecting shortlists for CPTPP contractor selection

According to Decree 95/2020/ND-CP, based on the scale and nature of the package, the shortlist selection process is carried out to select contractors who meet the capacity and experience requirements of the package to be invited to bid. The shortlist selection process is decided by the authorized person and must be clearly stated in the contractor selection plan in Vietnam. The steps for shortlist selection include:

Step 1: Preparation of the EOI request:

- The EOI request includes the following contents: Summary information about the project/package; instructions for preparing and submitting the expression of interest; standards for the contractor's capacity and experience, including requirements for the number, qualifications, and experience of experts;

- Use the point-scoring method on a 100 or 1,000-point scale to develop evaluation criteria for the expression of interest, of which the required minimum score must not be less than 60% of the total score, and the evaluation score for each aspect of capacity, experience, and personnel must not be lower than 50% of the maximum score for that aspect;

Step 2: The approval of the EOI request must be in writing and based on the approval submission and the appraisal report of the EOI request;

Step 3: Announcement of the EOI request must be implemented in accordance with point b clause 1, clause 3 Article 9, and clause 2 Article 10 of this Decree;

Step 4: Issuance of the EOI request: The EOI request is issued free of charge on the Vietnam E-Procurement System immediately after successfully posting the announcement of the EOI request;

Step 5: Receipt and management of expressions of interest:

- In case the procuring entity receives the expressions of interest not through the network: The procuring entity receives and manages the submitted expressions of interest according to confidential file management policies until the results of the expression of interest are publicly disclosed;

- In case the procuring entity receives the expressions of interest through the network: The Vietnam E-Procurement System notifies the contractor of the submission status of the expression of interest (successful or unsuccessful). The Vietnam E-Procurement System will record the following information about the submission of the expression of interest by the contractor: information about the sender, receiver, submission time, submission status, and number of attached files on the Vietnam E-Procurement System;

Step 6: Opening the expressions of interest:

- In case the procuring entity receives the expressions of interest not through the network: The expressions of interest submitted according to the time and place specified in the EOI request will be opened immediately after the deadline for submission. The opening of the expressions of interest must be recorded in minutes, and the opening minutes must be sent to the bidders who submitted the expressions of interest. Expressions of interest submitted after the deadline will not be opened, be invalid, and be excluded;

- In case the procuring entity receives the expressions of interest through the network: The procuring entity opens the expressions of interest on the Vietnam E-Procurement System immediately after the deadline for submission. The opening minutes of the expressions of interest are publicly posted on the Vietnam E-Procurement System within 02 hours from the deadline for submission;

Step 7: Evaluation of the expressions of interest: The evaluation of the expressions of interest is performed according to the evaluation criteria specified in the EOI request. The expressions of interest with an evaluation score not lower than the required minimum score will be included in the shortlist; the expression of interest with the highest score will be ranked first; in case more than 06 bidders meet the requirements, the 06 highest-ranked bidders will be selected for the shortlist;

Step 8: Submission, appraisal, and approval of the expression of interest results:

Step 9: Disclosure of the shortlist: The shortlist must be posted according to the provisions at point d clause 1 and clause 3 Article 9 of this Decree, and a notification must be sent to the bidders who submitted the expressions of interest.
