Use of data and information of the civil judgment enforcement statistics report in Vietnam as of July 26, 2024

Recently, the Ministry of Justice has issued a document regulating the reporting regime for civil judgment enforcement statistics and regime for monitoring administrative judgment enforcement in Vietnam.

On June 10, 2024, the Minister of Justice issued Circular 05/2024/TT-BTP, on the reporting regime for civil judgment enforcement statistics and regime for monitoring administrative judgment enforcement in Vietnam.

Use of data and information of the civil judgment enforcement statistics report in Vietnam as of July 26, 2024

Data and information in the civil judgment enforcement statistics report will be used as one of the bases for deciding the following key issues:

  • Assessing the performance results of civil judgment enforcement targets and tasks; the organization and activities status of civil judgment enforcement agencies, enforcers, verifiers, clerks, and other officials during reporting periods and annual reports.

  • Planning civil judgment enforcement and assigning annual civil judgment enforcement targets and tasks to civil judgment enforcement agencies and enforcers.

  • Allocating staff; evaluating, planning, appointing, reappointing officials in leadership and management; training, fostering, rotating, transferring, and dismissing enforcers, verifiers, and officials of civil judgment enforcement agencies.

  • Determining the level of target and task completion, and summarizing and evaluating competitions and rewards for civil judgment enforcement agencies and enforcers.

  • Implementing the financial regime in civil judgment enforcement; considering and deciding on financing for the construction of headquarters, evidence warehouses; providing working facilities for the Civil Judgment Enforcement System and other aspects related to ensuring finances and physical facilities to implement civil judgment enforcement targets and tasks.

  • Reporting to the Government, the National Assembly Standing Committee, the National Assembly, and competent authorities as prescribed by law.

  • Evaluating the results of administrative judgment enforcement as a basis for proposing responsibility handling in administrative judgment enforcement.

  • Using in other tasks for the purpose of managing and directing civil judgment enforcement activities.

Forms of reporting and methods of submitting civil judgment enforcement statistics reports in Vietnam as of July 26, 2024

The forms of reporting and methods of submitting civil judgment enforcement statistics reports are specified in Article 9 Circular 05/2024/TT-BTP as follows:

Civil judgment enforcement statistics reports are presented in the form of paper documents or electronic documents:

  • Paper documents must have the signature and name of the report compiler; the signature and name of the unit head and the official seal as prescribed. Enforcer reports must have the signature of the enforcer and the confirmation of the unit head;

  • Electronic documents are either images (pdf format) of paper reports or electronic documents in the form of electronic files authenticated by the digital signature of the head of the civil judgment enforcement agency as prescribed by law.

Civil judgment enforcement statistics reports are submitted by the following methods:

  • Sent via official email issued by the Ministry of Justice (*@moj.gov.vn);

  • Sent through the Ministry of Justice's document management software (qlvb.moj.gov.vn);

  • Submission of civil judgment enforcement statistics reports in the military is conducted in accordance with regulations of the Ministry of National Defense and the guidance of the Judgment Enforcement Department under the Ministry of National Defense.
