1. Rules of using open data of regulatory agencies

Rules of using open data of regulatory agencies in Vietnam as stipulated in Article 18 of Decree 47/2020/ND-CP includes:

  • Agencies, organizations, and individuals are allowed to freely copy, share, exchange, use open data, or combine open data with other data; use open data in their commercial or non-commercial products and services.

  • Agencies, organizations, and individuals must cite and acknowledge the use of open data in their related products and documents involving open data.

  • Open data from state agencies are provided in their original form as published; they do not include presentation formats and other information derived from the provided open data.

  • Agencies, organizations, and individuals are not permitted to sell open data that has been directly extracted from state agencies to other organizations and individuals. When using open data in their commercial products and services, they must provide the open data free of charge alongside those commercial products and services.

  • State agencies are not responsible for any losses or damages incurred by agencies, organizations, and individuals resulting from the use of open data.

2. Rules of providing open data of regulatory agencies in Vietnam

Rules of providing open data of regulatory agencies in Vietnam as stipulated in Article 17 of Decree 47/2020/ND-CP are as follows:

  • The provision of open data of regulatory agencies to organizations and individuals must adhere to these principles:

    • Open data must be integral and fully reflect the information content provided by the state agencies;

    • Open data provided must be the most newly updated data;

    • Open data must be accessible and usable on the internet;

    • Open data must ensure devices can send, receive, store, and process the data;

    • Organizations and individuals are free to access and use the open data without requiring identification declaration when extracting and using the open data;

    • Open data should be in an open format;

    • Using open data is free of charge;

    • Priority should be given to providing open data for data with high usage demand from the public and businesses.

  • Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of the provincial People's Committees, and centrally-affiliated cities are responsible for issuing open data catalogs of state agencies, organizing the plan construction, and publicizing open data of state agencies within their management scope.

3. Regulations on plans and implementation of open data of regulatory agencies in Vietnam

According to Article 19 of Decree 47/2020/ND-CP, within their management, ministerial agencies, governmental agencies, People’s Committees of provinces and central-affiliated cities are responsible for implementing following activities:

  • Developing and implementing the open data plan, including the plan to publicize open data, and the minimum level that must be achieved in each phase of the plan.

  • Determining the mechanism for collecting and analyzing feedback information from individuals and organizations on the use of open data; designating contact points to receive feedback from organizations and individuals on issues related to the quality, availability, format, and compliance with legal regulations related to open data.

  • Implementing necessary preventive measures to maintain the construction and publicizing of open data directly related to activities that protect human safety and property affected by the open data implementation plan within their agency.

  • Carrying out measures to encourage organizations and individuals to use open data:

    • Receiving feedback from organizations and individuals to identify priority levels and appropriately publicize open data according to demand;

    • Supporting society and community organizations and individuals to carry out activities to build and contribute to expanding open data.
