On June 28, 2024, the Minister of Finance issued Circular 43/2024/TT-BTC which stipulates the collection levels of several types of fees and charges to continue alleviating difficulties and supporting business activities, including the reduction of 36 types of fees and charges from July 1, 2024, to December 31, 2024.

According to Article 1 Circular 43/2024/TT-BTC, regarding the collection levels of several types of fees and charges to continue alleviating difficulties and supporting business activities, the fees for approval of fire prevention and fighting design approval in Vietnam are stipulated as follows:

Equal to 50% of the fee collection levels specified in Article 5 Circular 258/2016/TT-BTC dated November 11, 2016, of the Minister of Finance, stipulating the collection levels, regime of collection, payment, management, and use of fees for approval of fire prevention and fighting design approval in Vietnam.

 According to Clause 3, Article 5 Circular 258/2016/TT-BTC, the fee collection level for fire prevention and fighting design approval in Clause 1 and Clause 2, Article 5 Circular 258/2016/TT-BTC is 500,000 VND/project and a maximum of 150,000,000 VND/project.

Note: From January 1, 2025, onwards, the fee collection will follow the regulations in Circular 258/2016/TT-BTC and any amended, supplemented, or replaced Circulars (if any).

Management and use of fees for approval of fire prevention and fighting design in Vietnam

  • Collecting organizations are allowed to retain 80% of the collected fees to cover expenses as per the regulations in Article 5 Decree 120/2016/ND-CP dated August 23, 2016, of the Government. This includes other related expenses such as:

    • Additional or replacement expenses for the purchase, lease of fire prevention and fighting equipment, supporting the storage of approval records as stipulated by Circulars and guidelines of the Ministry of Public Security;

    • Expenses for the project approval council; hiring organizations to perform the project appraisal; purchasing and translating documents, standards, and technical regulations for the approval work; overtime remuneration for individuals conducting the appraisals and collecting fees; training and professional development for the approval work.

  • The remaining 20% is paid into the state budget according to the current budget catalog.

Fire prevention and fighting design approval (hereinafter referred to as fire prevention and fighting approval) is understood as the Fire Prevention and Fighting Police Department conducting inspections, cross-checking project design solutions and their content against technical standards, regulations, and relevant Vietnamese laws, as well as foreign and international fire prevention and fighting standards permitted in Vietnam according to procedural regulations stipulated in Article 15 Decree 79/2014/ND-CP dated July 31, 2014, of the Government.
