The Prime Minister to issue the Plan to implement the Law on Electronic Transactions 2023 in Vietnam (Internet image) 

Regarding this issue, LawNet would like to answer as follows:

On October 13, 2023, the Prime Minister issued Decision 1198/QD-TTg on the Plan to implement the Law on Electronic Transactions 2023.

The Prime Minister to issue the Plan to implement the Law on Electronic Transactions 2023 in Vietnam

In order to implement the Law on Electronic Transactions 2023 promptly, consistently, and effectively, the Prime Minister issued the Plan to Implement the Law on Electronic Transactions 2023 with the following contents:

- Review legal documents

+ Content: Review legal documents related to the Law on Electronic Transactions 2023 under assigned state management authority; Implement according to authority or propose competent authorities to promptly amend, supplement, replace, abolish, or promulgate new legal documents, ensuring compliance with the provisions of the Law on Electronic Transactions 2023 and detailed regulations under the Law (based on the results of the specialized review of electronic transactions, implemented according to Decision 06/QD-TTg of the Prime Minister approving the Project to develop the application of population data, electronic identification, and authentication to serve national digital transformation in the period 2022–2025, with a vision to 2030):

(i) The Ministry of Information and Communications presides over guidance on the new contents of the Electronic Transactions Law as a basis for review; Review legal documents related to the Law on Electronic Transactions 2023 under assigned state management authority; synthesize review results, and report to the Prime Minister.

(ii) Ministries, ministerial-level agencies, People's Committees of provinces and centrally run cities shall review legal documents related to the Law on Electronic Transactions 2023 in the assigned fields and areas of state management and send the results to the Ministry of Information and Communications for synthesis in May 2024.

+ Completion time: August 2024.

- Develop legal documents detailing the assigned contents of the Law on Electronic Transactions 2023

+ Develop documents according to Decision 857/QD-TTg in 2023 of the Prime Minister promulgating a list and assigning agencies to preside over the drafting of documents detailing the implementation of laws and resolutions passed by the 15th National Assembly at its 5th session, related to the Law on Electronic Transactions 2023.

Submission deadline: according to Decision 857/QD-TTg. For the Decree on Shared Database, the deadline for submission to the Government is May 2024.

+ Develop the Prime Minister's Decision approving the National Database List.

Responsible agency: The Ministry of Information and Communications presides and coordinates with relevant ministries and agencies.

Submission deadline: May 2024.

+ Ministers and Heads of ministerial-level agencies review relevant legal regulations to promulgate according to authority or submit to competent authorities to promulgate regulations on entering into and implementing electronic contracts in the field within the scope of assigned tasks and powers, in accordance with practical conditions.

Implementation time: annually.

- Propaganda, dissemination, and education of laws on electronic transactions

+ Activity content:

(i) Post and update the full text of the Law on Electronic Transactions 2023 and detailed regulations on the Portal/Electronic Information Page, National database of legal documents, and other appropriate forms for officials, civil servants, public employees, workers, and other people to easily access, exploit, and use.

(ii) Determine the content and form of law dissemination appropriate to each target group and area; Compile, post, and widely distribute dissemination documents and coordinate with the Ministry of Justice (Department of Legal Education Dissemination) to update on the National Legal Education Dissemination Electronic Information Portal, http://pbgdpl.gov.vn.

(iii) Organize propaganda and dissemination of legal education on electronic transactions in specific forms; coordinate with press agencies to organize columns, programs, news, popular articles, and other forms according to the provisions of the law on dissemination and education of laws appropriate to each specific subject.

(iv) The Ministry of Information and Communications directs and guides press and media agencies and grassroots radio networks to strengthen information and communication and disseminate laws on electronic transactions.

+ Implementing agency: Ministry of Information and Communications, ministries, ministerial-level agencies, People's Committees of provinces, and centrally-run cities disseminate laws on electronic transactions by field and area within the scope of assigned tasks and powers.

+ Implementation time: annually.

- Implement plans, projects, schemes, programs, and activities at the national level to implement electronic transaction development policies specified in Article 4 of the Law on Electronic Transactions 2023.

+ Content: review, organize, and evaluate the implementation of ongoing national strategies, programs, plans, and projects related to promoting electronic transactions; Propose amendments, supplements, or develop new tasks and solutions (if necessary) to comply with the provisions of the Law on Electronic Transactions 2023.

+ Implementing agency: Ministry of Information and Communications; Ministries, ministerial-level agencies, and provincial-level People's Committees are assigned to preside over or submit for promulgation strategies, programs, plans, and projects related to promoting electronic transactions according to fields and areas within the scope of assigned tasks and powers.

Implementation time: annually.
