Tasks to be Performed During the Inspection of Legal Normative Documents by the Ministry of Health (MOH)

Circular 19/2015/TT-BYT stipulates the inspection, handling, review, and systematization of legal documents in the state management field of the Ministry of Health dated July 15, 2015.

To be specific, in Article 21 of Circular 19/2015/TT-BYT, it is stipulated that based on the requirements and annual activity plans regarding document inspection, the Legal Department will submit to the Minister a decision to establish an inspection team by topic and location, clearly stating the inspection duration. Agencies, units, and localities (collectively referred to as agencies) with documents subject to inspection are responsible for preparing the contents and requirements of the document inspection plan by topic and location.

The tasks to be performed in the inspection process include:

- The inspection team sends a notice of the plan, inspection schedule, and necessary requirements to the agency with the documents to be inspected at least 15 (fifteen) working days before conducting the inspection;- The agency with documents to be inspected reviews, lists the documents, self-inspects the documents according to the inspection team's guidance, and sends one (01) copy of the documents to the inspection team for review before working directly at the agency with documents to be inspected;- The process and procedures for document inspection are conducted in accordance with the provisions of Section 1, Chapter II of this Circular;- The inspection team works directly at the agency with documents to be inspected; the agency with documents to be inspected is responsible for arranging personnel to work with the inspection team, reporting self-inspection results, and providing necessary documents upon request;- At the end of the inspection, the head of the inspection team and the leader of the agency with documents to be inspected sign a working minutes to agree on the document inspection results;- The inspection team is responsible for reporting to the Minister and notifying the unit with documents inspected about the inspection results;- In case documents are found to show signs of legal violations, the Legal Department drafts a notification for the Minister's consideration and issuance. The notification is sent to the agency with documents to be inspected for self-inspection and handling in accordance with the law.
