Regarding this issue, LawNet would like to answer as follows:

1. Who is eligible to be appointed to political commissars of communes in Vietnam?

According to Clause 1, Article 20 of the Law on Militia and Self-defense Forces 2019, military commands of communes are standing agencies performing national defense tasks of communes. Compositions of military commands of communes include:

- Commanding officers that are members of People’s Committees of provinces and reservists; during national defense emergencies and at war, shall be conscripted for active duty as specified in Law on People’s Army of Vietnam and shall continue to hold title of commanding officers of military commands of communes;

- Political commissars shall be assigned to secretaries of Party Executive Committees of communes;

- Deputy political commissars shall be assigned to secretaries of Ho Chi Minh Communist Youth Union;

- Deputy commanders are part-time activists in communes.

According to the above regulations, the political commissars shall be assigned to secretaries of Party Executive Committees of communes.

2. Standards for political commissars of communes in Vietnam

- General standard:

In Clause 1, Article 7 of Decree 33/2023/ND-CP stipulating the general standards of commune-level cadres and civil servants (including the Secretary of the Party Committee) are as follows:

Commune-level cadres and civil servants shall comply with the current provisions of the law on cadres and civil servants, the organization's charter, and the regulations of the Party and socio-political organizations at the central level.

- Private standards:

+ Age: When holding a position for the first time, you must be of working age for at least one full term (60 months), in special cases under the decision of the agency competent to manage cadres;

+ General education level: Graduated from high school;

+ Professional and professional qualifications: University graduate or higher.

+ Degree in political theory: High school diploma or equivalent or higher.

+ Other standards as prescribed by the Party and competent agencies managing cadres.

Note: In case the Party's Charter has provisions different from those in Decree 33/2023/ND-CP, the provisions of the Party's Charter shall apply;

3. Tasks of political commissars of communes in Vietnam 

Political commissars of communes have the following tasks:

- Advise and propose to the commune-level Party Committee (cell) to decide on the contents and measures to lead all activities of the militia and reserve forces and in performing national defense and military tasks at the commune level in accordance with the Party's guidelines and guidelines, the State's policies and laws, resolutions, directives, and orders of superiors on defense and military work.

Propose to politicians of the district-level military command the contents and measures to conduct party and political work.

Formulate plans and directly carry out party and political work in the militia, reserve, and mobilization forces, in the performance of defense and military tasks at the commune level;

- Carry out political and ideological education;

Build up a militia and reserve force at the commune level that is absolutely loyal to the Party, the Fatherland, and the People, with solid political will;

There is no deterioration in political ideology, morality, lifestyle, self-evolution, or self-transformation;

Be willing to receive and complete all assigned tasks;

Together with commune-level departments, branches, and mass organizations, organize national defense and security education, encourage the People to participate in building the armed forces, and consolidate the national defense of the whole people;

- Conduct party building organizations; build a clean and strong military cell (if any), take care of building a political core force in the militia and mobilization reserve;

Detect and foster subjects for admission to the party and unions in the militia and mobilization reserve.

Build a temporary living cell in the militia and mobilization reserve (if any) that is clean, strong, and successfully performs all assigned tasks;

- Conduct staff work;

Build up militia commanders and mobilize reserve cadres of sufficient quantity and quality, to fulfill their assigned responsibilities and tasks and meet the requirements of national defense and military tasks.

Coordinate with mobilization framework units to arrange, manage, and organize training for reserve officers in the locality;

- Conduct internal political protection work;

Build up a militia and reserve mobilization force that is politically clean and safe in all respects;

Propagate and educate the militia, reserve, and mobilization forces and the people to raise their vigilance and fight to defeat the plots and tricks of hostile forces, contributing to maintaining political security in the locality;

- Guide militia and mobilization reserve forces to conduct mass mobilization work;

Participate in the implementation of movements and campaigns launched by the Party, State, Vietnam Fatherland Front, the Army, and localities, contributing to maintaining political stability, economic and cultural development,
society, strengthening national defense and security, building a strong local political base, and building a safe area;

- Organize the implementation of the Party and State's policies towards the militia, reserve, and mobilization forces and the rearward policy of the Army;

Study and propose to superiors to improve regimes and policies for the Militia and Self-Defense Forces, reserve and mobilization forces, and policies on the Army's rear and local defense and military tasks;

- Conduct party work and political work in the construction, training, and activities of the militia, reserve, and mobilization forces, prepare and call citizens to join the army, perform mobilization tasks;

Build fighting villages, communes, wards, and townships;

Organize civil defense and perform other defense and military tasks at the commune level;

- Conduct preliminary and final reviews of party and political work for the militia, reserve, and mobilization forces, as well as defense and military tasks at the commune level.
