This is a notable regulation in Circular 162/2018/TT-BQP on guidelines for implementing special allowance policies for the Guard forces under the Ministry of National Defense.
Circular 162 stipulates that the special allowance level is paid together with the monthly salary and is not used to calculate contributions and benefits for social insurance (BHXH) and health insurance (BHYT) policies. Furthermore, the implementation of the special allowance policy must also ensure the following principles:
- Officers and professional military personnel in the guard force who are eligible for a certain level of special allowance will receive the special allowance level prescribed for that group. In case an individual qualifies for multiple levels of special allowance, only the highest allowance level will be applied.- When appointed or assigned to guard duties for a period of 01 month or more, the individual will receive the special allowance policy, and it will be calculated from the month in which the decision is made.- When there is a change in operational position, military rank for officers, or salary level for professional military personnel, the corresponding special allowance level based on the new position, rank, or salary level will be applied from that month.- Individuals mentioned in Clause 1 and Clause 2 Article 2 of Circular 162 will not receive the special allowance in the cases specified in Circular 162.
