Article 8 of Decree 112/2013/ND-CP clearly stipulates the rights and obligations of the deported persons as follows:
Rights of deported persons:
- To be informed of the reason for deportation and receive the deportation decision no later than 48 hours before execution;- To contact the diplomatic or consular representative office of the country of their citizenship for protection and assistance;- To exercise policies for deported persons during the deportation procedure at the accommodation facility while waiting for deportation procedures;- To take their lawful assets out of the territory of Vietnam;- To lodge complaints and denunciations in accordance with the law on complaint and denunciation resolution.
Obligations of deported persons:
- To fully comply with the provisions stated in the deportation decision;- To present personal identification documents as required by the immigration management agency;- To comply with the laws of Vietnam and be subject to the management of the police authority during the deportation procedure;- To promptly fulfill civil, administrative, and economic obligations as regulated by law (if any). In cases of non-voluntary compliance, preventive measures and administrative violation handling will be applied as stipulated in Chapter I, Part Four of the Law on Handling Administrative Violations;- To complete the necessary procedures to leave the territory of Vietnam.
