Responsibilities of the Lead Information Provider Unit

Decree 13/2018/ND-CP detailing the Law on Access to Information was signed and promulgated by the Government of Vietnam on January 23, 2018, with many notable contents. An example is the provision on the responsibilities of the focal unit for information provision.

To be specific, according to regulations stipulated in Article 8 of Decree 13/2018/ND-CP, the focal units for providing information have the following responsibilities:

First, allocating personnel to serve as the focal point for providing information to fulfill the information provision requirements as stipulated by the Law on Access to Information.

Second, receiving and processing requests for providing information from citizens; taking the lead and cooperating with related units to handle these requests and fulfill the provision of information to citizens as requested.

Third, explaining, guiding, and informing citizens on their right to access information according to the correct procedures; guiding and supporting the requester in clearly identifying the records, documents, and titles of documents containing the needed information to accurately fill out the Request for Information Form.

Fourth, receiving and responding to, or cooperating with relevant units to respond to, feedback, petitions, complaints, and denunciations from organizations and citizens regarding the provision of information by their agency as regulated by relevant laws; making recommendations and suggestions to the head of the agency on arising issues during the handling of citizen requests for information.

Fifth, monitoring and urging the resolution of citizen requests for information; summarizing the situation and results of the information provision work within the scope of the agency's responsibility; regularly and extraordinarily reporting to the head of the agency providing information.

Sixth, arranging officials to guide, explain and assist illiterate people, disabled people, and others facing difficulties in filling out the Request for Information Form; in the case that the requester cannot write the form, assisting in filling out the Request for Information Form.
