Responsibilities in reporting and declaration in the management of irrigation infrastructure in Vietnam (Illustration)

Decree 129/2017/ND-CP prescribes that all irrigation infrastructure must be reported to the state management agency on irrigation, the public asset management agency, and be declared, updated into the database on irrigation infrastructure and the national database on public assets for unified management. Therefore, the agency assigned to manage the assets is responsible for reporting and declaring as follows:

Forms of reporting and declaration

- Initial declaration for irrigation infrastructure being managed at the time this Decree takes effect;- Supplementary declaration for changes in irrigation infrastructure;- Supplementary declaration for changes in information about the agencies or units managing and exploiting the assets.

Declaration reporting deadlines

- For initial declaration reports: Within 60 days from the date the Ministry of Agriculture and Rural Development, the provincial People's Committee, or the district People's Committee, under decentralization, assigns the agency to manage the irrigation infrastructure as prescribed in Article 5 of this Decree;- For supplementary declaration reports: Within 30 days from the date of the change;- For declaration reports of changes in information about the managing agency: Within 10 days from the date of the change in the managing agency as decided by the competent authority.

Additionally, the policies on reporting the management and use of irrigation infrastructure are stipulated as follows:

Annually, the agency assigned to manage the assets must report on the management and use of irrigation infrastructure (including the amount of money obtained from the handling and exploitation of irrigation infrastructure) of the previous year and sudden reports at the request of the competent state agency according to Form No. 03/TSTL-BC, 04/TSTL-BC, 05/TSTL-BC issued with this Decree;

The deadline for sending reports on the management and use of irrigation infrastructure is prescribed as follows:

- The agency assigned to manage the assets shall prepare reports and send them to the Ministry of Agriculture and Rural Development, and the provincial People's Committee or the district People's Committee under decentralization before February 28 each year;- The Ministry of Agriculture and Rural Development shall consolidate the situation of water infrastructure asset management and use nationwide and send it to the Ministry of Finance before March 15 each year;- The Ministry of Finance shall consolidate the situation of water infrastructure asset management and use nationwide to report to the Government of Vietnam and the National Assembly as required and publicize the assets of the entire country.
