Regulations on the road traffic e-payment database management system in Vietnam (Internet image)

On September 30, 2024, the Government of Vietnam issued Decree 119/2024/ND-CP regulating road traffic e-payment.

1. Regulations on the road traffic e-payment database management system in Vietnam

According to Article 8 of Decree 119/2024/ND-CP, the road traffic e-payment database management system is as follows:

- The road traffic e-payment database management system in Vietnam must meet the following requirements:

+ The management system for the electronic payment database for road traffic is built according to relevant information technology standards, technical regulations, and economic-technical norms, ensuring stable and continuous operation;

+ Ensure connectivity with the systems and databases specified in Clause 2, Article 8 of Decree 119/2024/ND-CP;

+ Ensure the right to access information of agencies, organizations, and individuals according to the legal provisions on electronic transactions and other relevant laws.

- The road traffic e-payment database management system in Vietnam is connected to the following systems and databases:

+ The operation system and data center of the electronic payment service provider for traffic;

+ Database on road traffic order and safety;

+ National population database.

- Information in the electronic payment database for road traffic is centrally managed at the road traffic e-payment database management system in Vietnam as specified in the Appendix attached to Decree 119/2024/ND-CP.

- The costs of managing, operating, and exploiting the road traffic e-payment database management system in Vietnam are sourced from the expenses for organizing, managing, supervising fees, prices, and service charges related to vehicle traffic activities, and financial sources as specified in Clause 1, Article 42 of Law on Road Traffic 2024.

Article 42. Financial sources for investment, construction, management, operation, exploitation, maintenance of road infrastructure, and revenue from road infrastructure

1. Financial sources for investment, construction, management, operation, exploitation, and maintenance of road infrastructure are in accordance with the laws on state budget, investment, public investment, public-private partnership investment, management, and use of public assets, and other relevant legal regulations.

2. Guidance on road traffic e-payment in Vietnam

The road traffic e-payment is regulated in Article 43 of Law on Road Traffic 2024 as follows:

- Road traffic e-payment is the payment of fees, prices, and service charges related to road vehicle traffic activities through a traffic account.

- A traffic account is an account opened for the owner of a road vehicle and connected to a legal payment method to conduct cashless payments following the laws on banking.

- Payments for road usage on highways must be made via non-stop electronic toll collection.
