On December 5, 2024, the Prime Minister of the Government of Vietnam issued Official Telegram 127/CD-TTg regarding the rectification of the Certificates of extracted aquatic material and the Certificates of extracted aquatic products at localities in Vietnam.
To quickly address the above situation, the Prime Minister of the Government of Vietnam requests the Minister of Agriculture and Rural Development, chairpersons of the People's Committees of coastal provinces and centrally-run cities, and associations, enterprises in the exploitation, processing, and export of marine products to immediately carry out the following tasks and solutions:
(1) The Minister of Agriculture and Rural Development of Vietnam shall:
- Strengthen guidance, training, and workshops to ensure localities implement correctly the legal regulations in granting verification certifications and certifications for exploited marine products.
- Regularly guide and inspect, promptly rectify instances of granting verification certifications and certifications for exploited marine products that do not comply with current legal regulations or misunderstand them, requiring enterprises to provide dossiers and documents not stipulated in Circular 21/2018/TT-BNNPTNT and Circular 01/2022/TT-BNNPTNT of the Ministry of Agriculture and Rural Development, creating difficulties in granting verification certifications and certifications for the export of marine products.
- Review all regulations related to organizing, granting verification certifications, certification issuance; amend any regulations that are inappropriate, create difficulties, obstruct production, business activities in the field of exploitation, processing, and export of seafood; promptly report to the competent authority to amend, supplement content beyond authority.
(2) Chairpersons of People's Committees of coastal provinces and centrally-run cities of Vietnam shall:
- Organize and strictly implement the granting of verification certifications of exploited marine products (verification certificates), certification of origins of exploited marine products (certifications) with the following specific contents:
+ Direct competent authorities to currently issue verification certificates, certifications in conformity with current legislation and guidelines from the Ministry of Agriculture and Rural Development; do not require dossiers, procedures not prescribed by law.
+ Within their authority, review, adjust, supplement regulations to facilitate fishermen and enterprises in maintaining production, business, ensuring social welfare, socio-economic development in the locality.
+ Regularly organize inspection, supervision; strictly handle organizations, individuals that violate, intentionally cause difficulties for people and enterprises.
+ Promote and disseminate legal regulations on combating IUU exploitation so that fishermen fully understand and comply.
- Continue to definitively handle the status of "3 no" fishing vessels according to the request and time frame in Official Telegram 111/CD-TTg dated November 4, 2024, from the Prime Minister of the Government of Vietnam regarding focusing on implementing urgent, priority solutions against illegal, unreported, and unregulated (IUU) seafood exploitation, preparing to receive and work with the 5th Inspection Delegation of the European Commission; strengthen control of transshipment of exploited marine products at sea, strictly handling violations according to regulations.
(3) Associations, enterprises in the processing and export of marine products of Vietnam shall:
- Fully comply with regulations on the issuance of verification certificates, certifications; ensure the recording and storage of dossiers for traceability of exploited marine products in accordance with legal provisions.
- Coordinate with local authorities to support and propagate so that fishermen fully comply with the regulations against illegal marine exploitation.
- Coordinate with local authorities to support and propagate to ensure full compliance with anti-illegal exploitation regulations by fishermen.
Assign the Ministry of Agriculture and Rural Development to inspect, supervise, track, consolidate, and report to the Prime Minister the implementation results of this Official Telegram.
