On February 14, 2025, the Ministry of Finance issued Official Dispatch 1767/BTC-TCCB guiding the implementation of the early retirement policy and resignation according to the Decree 178/2024/ND-CP for organizations and units under the Ministry of Finance.

The Ministry of Finance guides the organizations and units under its jurisdiction on the implementation of early retirement and resignation policy according to the Decree 178/2024/ND-CP as follows:

(1) Scope and Subjects of Application

Officials, public employees; individuals working under labor contract policies as per labor law regulations prior to January 15, 2019, and individuals working under labor contract policies applied as officials (hereinafter referred to as laborers) in the agencies, organizations, and units of the Ministry of Finance due to organizational restructuring, including:

(i) Administrative organizations under the management of the Ministry of Finance;

(ii) Public service providers within the organizational structure of the Ministry of Finance;

(iii) Other public service providers not belonging to the organizational structure of the Ministry of Finance completing organizational restructuring or human resource restructuring within 12 months from the decision by the competent authority.

(2) Process for Resolving Early Retirement and Resignation Policy

- Step 1: The unit head gathers collective leadership and party committee opinions of the unit (by meeting or written consultation) on early retirement and resignation for officials, public employees, and laborers under the unit's management according to guidance in Section II of this Official Dispatch. For early retirement and resignation of the unit head, the direct leadership collective and party committee of the superior unit provide opinions.

- Step 2: The unit directly managing and using officials and public employees (Departments, Agencies, and equivalent belonging to the Ministry; departments of public service providers, sub-departments, and equivalent of vertically organized units, the State Securities Commission, public service providers under the Ministry) compile a list of subjects and funds for policy implementation, policies (for non-independent budget units, the budget estimation unit shall determine the funds) and submit dossiers to the competent authority (via the organization and personnel work advisory and financial work advisory agencies).

- Step 3: Assessment of the subjects

- Department of Personnel Organization appraises cases under the Minister's approval authority specified in point (i) of (1).

- Department/Division advising on organizational personnel work of the unit appraises cases under the unit's approval authority specified in (1).

- Step 4: Appraisal of funds (for cases already assessed as beneficiaries of policies)

+ Planning and Finance Department appraises cases under the Minister's approval authority at point (i) of (1).

+ Financial work advisory departments/divisions of units appraise funds for cases under the unit's approval authority at point (ii) of (1).

- Step 5: Compilation, submission for approval by the competent authority: Department (Division/Room) of Personnel Organization compiles the appraisal results, submits them for review and approval by the competent authority.

- Step 6: Report on policy implementation results: Decentralized units with approval authority for the beneficiaries and funds for early retirement and resignation report to the Ministry (through the Department of Personnel Organization, Planning and Finance Department) on the policy implementation for monitoring and inspection.
