The Ministry of Finance has just issued Circular 102/2017/TT-BTC providing guidance on certain provisions stipulated in Decree 03/2017/ND-CP dated January 16, 2017 of the Government of Vietnam concerning casino business operations.
Circular 102/2017/TT-BTC clearly states that in order for Vietnamese citizens to participate in casino gaming, their financial capability documentation must include proof of regular income of at least 10 million VND per month.
The documentation proving the player’s financial capability must include evidence of taxable income of at least the third tax bracket as stipulated in the Personal Income Tax Law; a certified copy of the personal income tax declaration that has been settled by the tax authority or a confirmation from the tax authority verifying that the player has taxable income of at least the third tax bracket as stipulated in the Personal Income Tax Law within one year before entering the casino.
In case individual documents do not prove the income level reaching 10 million VND per month, the player may present multiple documents simultaneously to prove such income.
For casino business enterprises, they must maintain a register or issue electronic cards to monitor all individuals entering and exiting the casino premises as stipulated in Article 14 of Decree 03/2017/ND-CP.
The register can be maintained in a written or electronic format. In cases where businesses implement control through electronic cards, they must ensure consolidated reporting on the monitoring of individuals entering and exiting similar to the register. The register and electronic information must be stored for a minimum period of 2 years to serve inspections and audits by state management agencies.
For enterprises authorized to pilot allowing Vietnamese nationals to play at casino premises as stipulated in Article 12 of Decree 03/2017/ND-CP, the register for Vietnamese nationals entering the casino must be stored for a minimum period of 5 years to serve the summary and evaluation of the pilot allowing Vietnamese nationals to play in casinos.
In January 2017, the Government of Vietnam issued a decree allowing domestic casinos to accept bets from Vietnamese players, with a trial period lasting for 3 years.
