Recently, the Ministry of Science and Technology has issued Circular 35/2014/TT-BKHCN Regulation on Judicial Expertise in Science and Technology Activities.
Procedures for appointment of judicial experts in science and technology activities in Vietnam (Illustrative Image)
The procedures for the appointment of judicial experts in science and technology activities are stipulated in Circular 35/2014/TT-BKHCN as follows:
- Dossier for requesting the appointment of judicial experts in science and technology activities:
- Official Dispatch requesting the appointment of judicial experts from the Head of the Unit;- A copy of the university degree or higher appropriate to the field of expertise requested for appointment;- Curriculum vitae and Judicial record sheet;- Confirmation of actual working time in the relevant field at the place where the appointee works.
- Procedures for appointing judicial experts:
+ At the Ministry of Science and Technology:
- The Head of the agency or unit under the Ministry selects individuals who meet the criteria specified in Article 4 of this Circular, prepares 01 (one) dossier requesting the appointment of judicial experts, and sends it to the Legal Department of the Ministry of Science and Technology (hereinafter referred to as the Legal Department);- The Legal Department reviews the dossier, selects, and submits to the Minister of Science and Technology for the decision to appoint judicial experts.
+ At the local level:
- The Department of Science and Technology, in coordination with the Department of Justice, selects individuals who meet the criteria specified in Article 4 of this Circular, receives the dossiers requesting the appointment of judicial experts as prescribed in Article 7 of this Circular, and submits them to the Chairman of the Provincial People's Committee for the decision to appoint judicial experts.
- Regarding the criteria for selecting judicial experts by case in the field of science and technology:
- Judicial experts by case in the field of science and technology are Vietnamese citizens, residing in Vietnam, who meet the provisions of Clause 1 or Clause 2, Article 18 of the Law on Judicial Expertise and do not fall under any of the cases specified in Clause 2, Article 4 of this Circular.
