Standards for the appointment of judicial experts in science and technology activities in Vietnam

This is one of the important contents specified in Circular 35/2014/TT-BKHCN Regulations on Judicial Assessment in Scientific and Technological Activities issued on December 11, 2014.

The standards for appointment of judicial experts in science and technology activities in Vietnam are regulated as follows:

  1. Vietnamese citizens who are permanently residing in Vietnam and meet the following criteria may be considered for appointment as judicial experts in scientific and technological activities:

- Possess good health and moral qualities;

- Hold a university degree or higher and have had at least 05 years of practical professional experience in the trained field.

  1. Persons in any of the following cases shall not be appointed as judicial experts in scientific and technological activities:

- Incapable of civil acts or having restricted civil act capacity;

- Being prosecuted for criminal liability; having been convicted but not yet having their criminal records expunged for negligent crimes or less serious intentional crimes; having been convicted of serious, very serious, or particularly serious intentional crimes;

- Currently undergoing administrative measures for education at commune, ward, or commune-level town, being sent to compulsory drug rehabilitation centers, or being sent to compulsory education centers.

  1. In addition to the provisions in Clause 1 and Clause 2 of this Article, judicial experts in the fields of technology, equipment, machinery, and atomic energy must hold a university or postgraduate degree in one of the following fields:

- Engineering for judicial expertise in technology, equipment, machinery;

- One of the fields of nuclear physics, nuclear technology, or radiochemistry for judicial expertise in atomic energy.
