Regarding this issue, LawNet would like to answer as follows:
On August 1, 2023, the Minister of Public Security issued Circular 32/2023/TT-BCA on the tasks, powers, forms, content, and procedures of patrolling, controlling, and handling administrative violations of road traffic by the Traffic Police.
Specifically, from September 15, 2023, the traffic police's order to stop vehicles will be prescribed as follows:
(1) The Traffic Police's order to stop a vehicle is made through one of the following signals or a combination of the following signals simultaneously:
- Traffic command sticks, horns, speakers, and priority signals for patrol and control vehicles;
- Other signals as prescribed by law, including: signs, marker posts, and fences.
(2) Signal to stop the vehicle when controlling at a point on the road, at the Traffic Police Station
- Traffic Police officers choose a suitable position, stand at attention, facing the vehicle that needs to be controlled, and signal to stop the vehicle at a safe distance; The right hand holds the traffic command stick, raises it and points it at the vehicle that needs to be controlled, and at the same time blows the whistle decisively, instructing the driver of the vehicle that needs to be controlled to stop in a suitable, safe location to control;
- When receiving the signal, the vehicle driver must slow down and stop the vehicle in a position according to the instructions of the Traffic Police.
(3) Signaling to stop a vehicle while sitting on a patrol or mobile control vehicle
- In case the patrol and control vehicles are going in the same direction and in front of the vehicle that needs to be controlled
Traffic Police officers hold a traffic command stick and move it horizontally to the right or left side of the patrolling and controlling vehicle (depending on the part of the road and lane where the vehicle needs to be controlled). then bring it up vertically, perpendicular to the ground; use horns and speakers; give priority signals to patrol and control vehicles; and guide drivers of vehicles that need to be controlled to stop in appropriate, safe locations for control.
When receiving the signal, the vehicle driver must slow down and stop the vehicle in a position according to the instructions of the Traffic Police officer;
- In case the patrol and control vehicles are going in the same direction and behind the vehicle that needs to be controlled
Traffic Police officers use loudspeakers to broadcast priority signals to patrol and control vehicles; instruct drivers of vehicles that need to be controlled to stop in appropriate, safe locations for control.
In case of necessity, if safety is ensured, patrol and control vehicles can pass in front of the vehicle that needs to be controlled and execute the command to stop the vehicle as prescribed in Point a, this Clause.
When receiving the signal, the vehicle driver must slow down and stop the vehicle in a position according to the instructions of the Traffic Police officer.
(Article 17 of Circular 32/2023/TT-BCA)
According to Article 7 of Circular 32/2023/TT-BCA, the tasks of the Traffic Police in patrol and control are as follows:
(1) Comply with the provisions of law and orders, patrol plans, and the control and handling of violations issued by competent authorities.
(2) Patrol, control, and handle violations of ensuring road traffic order and safety within assigned routes and areas.
(3) Detect, promptly prevent, and handle road traffic violations and other legal violations according to regulations; coordinate with road management agencies to detect and prevent violations of regulations on the protection of road works and road safety corridors.
(4) Investigate and resolve traffic accidents according to the provisions of the law and the Ministry of Public Security.
(5) Directly and coordinate with units inside and outside the People's Public Security Force to fight against crime and other illegal acts on road traffic routes. Participate in anti-terrorism and anti-disturbance protests; prevent and fight epidemics, natural disasters, and fires; and rescue and rescue on road traffic routes according to regulations.
(6) Through patrolling, controlling, and handling violations, perform the following tasks:
- Detect loopholes, shortcomings, and inadequacies in state management of security, order, and road traffic to report and propose to competent authorities to recommend timely remedial measures to functional agencies;
- Guide, propagate, and mobilize people to participate in ensuring road traffic order and safety and comply with road traffic laws.
(7) Perform other tasks of the People's Public Security Force according to the provisions of the law.
