Procedures for recognizing foreign organization providing certification service of electronic signature in Vietnam from August 15, 2024 (Internet image)

On July 1, 2024, the Minister of Information and Communications (Hanoi, Vietnam) issued Circular 06/2024/TT-BTTTT stipulating the recognition of foreign organization providing certification service of electronic signature in Vietnam; the recognition of foreign electronic signatures, and electronic signature certificates in Vietnam.

Procedures for recognizing foreign organization providing certification service of electronic signature in Vietnam from August 15, 2024

In Article 4 of Circular 06/2024/TT-BTTTT, the procedures for recognizing foreign organization providing certification service of electronic signature in Vietnam are stipulated as follows:

- Foreign organization providing certification service of electronic signature submit the recognition application, opting for one of the following methods: in person, via postal mail, or online, as guided below:

• Submit directly or via postal mail to the Ministry of Information and Communications (National Electronic Authentication Service Provider), at 18 Nguyen Du - Hai Ba Trung - Hanoi.

• Submit online through the online public service system (National Public Service Portal, https://dichvucong.gov.vn or the Ministry of Information and Communications Public Service Portal, https://dichvucong.mic.gov.vn).

• Documents issued, recognized, or certified by competent foreign authorities must be legalized according to Vietnamese law (unless exempt from consular legalization as per the law on consular legalization) and notarized translated into Vietnamese.

-Within 45 days from the date of receiving a valid application, the Ministry of Information and Communications (National Electronic Authentication Service Provider) will coordinate with the Ministry of Public Security to review, evaluate the application, and verify the status of the electronic signature certificate of the foreign electronic signature authentication service provider seeking recognition in Vietnam.

-If the conditions are met:

• The Ministry of Information and Communications will issue a recognition certificate for the foreign electronic signature authentication service provider in Vietnam. The Certificate of Recognition is specified in Template No. 02 attached to Circular 06/2024/TT-BTTTT.

• The National Electronic Authentication Service Provider will recognize the electronic signature certificate of the recognized foreign electronic signature authentication service provider in Vietnam and publish the electronic signature certificate on the Trusted Service System.

-If conditions are not met, the Ministry of Information and Communications (Hanoi, Vietnam)  will notify and state the reasons.

- For organizations carrying out administrative procedures in the electronic environment or online public services, the receipt, processing of application, and issuance of results will be conducted as per the Government's regulations on administrative procedures implementation in the electronic environment and the provision of online public services.
