Specifically, Article 15 of Decree 16/2006/ND-CP stipulates the procedures for provision of supports for persons suffering health damages and persons suffering loss of lives. Those who suffer health damages, families of persons who suffer loss of lives due to their participation in national security protection, or their legal representatives have the right to directly request or send an application to the specialized agency responsible for national security protection where they reside, requesting an allowance. The application must clearly state the details of the incident that caused the damage, the injuries, health impairments, loss of lives, along with supporting documents, invoices confirming costs, death certificates in case of fatality, and other relevant documents to serve as a basis for the responsible agency to review and decide on the allowance.
Upon receiving a direct request or an application for allowance from persons suffering health damages, families of persons suffering loss of lives due to participation in national security protection, or their legal representatives, the specialized agency responsible for national security protection that received the request or application must address the issue within no later than 15 days, as follows:
- Review, decide, or recommend the appropriate authority to review and decide on provision of supports for persons suffering health damages directly managed by their agency;
- Transfer the request or application and other related documents (if any) to the specialized agency responsible for national security protection managing the person suffering health damages to review and decide on the allowance;
- Review, conclude, and propose to the district or provincial People's Committee, where the person suffering health damages resides, to review and decide on compensation for the damages (in cases where the person suffering health damages is not managed by the specialized agency responsible for national security protection);
- Collect documents, conduct investigations, verify, conclude, propose, or transfer to the specialized agency responsible for national security protection directly managing the person suffering loss of lives to verify and conclude a proposal to the Department of Labor, Invalids, and Social Affairs or the Ministry of Labor, Invalids, and Social Affairs for review and decision on the allowance;
- The specialized agency responsible for national security protection receiving the allowance request must notify the applicant of the handling of their request according to the above regulations. If it is found that there are insufficient grounds to grant an allowance to the person suffering damages, a written notice explaining the reasons must be provided to the person.
